This is California, college tribunals filled with some of the most radical leftist academics in the country, who need only a 50%+ "ehh, he's a guy, probably happened". While the law may say one thing, it will be enforced in a different manner, where men are found guilty and women are found innocent. There will then be more lawsuits against universities by men, until there are enough complaints that the leftist-run state govt decides to pass a new law that says "these tribunals are similar to court proceedings, and since it is illegal to sue a judge for his decision, so too is it illegal to sue based on a tribunal's decision." Just wait and see, I would expect it won't take all that many decisions against universities by "rapists" before they do this.

Problem is that men will not be the first complainant in cases of mutually drunken sex. At best they will try a counter charge after the accusation. The counter charge would carry far less weight. And even should the initial charge be made by a male student, the feminist--why mince words--tribunal would never find the female student culpable, and just might encourage her counter charge...which would be successful.

Short of some kind of class action challenge, I don't see a way out for men. (Here, again, is where the MRM's lack of organization bites us on the ass.)

If a man and woman both have sex and both have had alcohol, it seems the man would have to report first defensively. Not to do so would take a huge risk since the law puts the accused in a much weaker position. Social expectations put most men at a disadvantage already.

The law seems to force a race to report between any parties.

California college men, if you've both had drinks, physically interact with a woman, and don't report, you're taking a big risk. This law suggests you should report your lack of ability to consent immediately, before she can.

Definitely agree here. If enough women are brought up on stupid-ass sexual assault charges? Maybe they'll realize how idiotic this law was.

Or maybe we'll get a bunch of women thrown out of school for nothing. At least it'd be equal, then.

I hate to break it to you, but i'm pretty sure any male who tries to use this law will be laughed out of court. Nearly every female that invokes it will be successful. Men need to understand, that CA is a hostile life environment and should move out.

So, wait.

As I understand the new law, a man could entice a woman into bed with him, appear to consent to sex, then later claim that he had silently revoked consent to sex during the act without putting up a struggle, and that he was therefore raped or sexually assaulted - and as long as the woman didn't continually seek and receive explicit consent, the law as written would be 100% on his side.

Presumably, then, not only could he sue the school for allowing his rapist to remain on campus if it doesn't rule in his favor, but he could actually go to the police and file charges against the woman in a court of law.

You know, it seems like we've trying to tell people these standards are wide open for abuse for a whole now. I wonder how many women would have to get burned by this law before people finally start listening.
