I pay $858 per WEEK for my three kids. Plus a significant portion of my bonus if I get one. I got laid off after my divorce closed and am making 22% less in my salary. I asked her to change it amicably, and she hit the roof, so I’m back in the legalese.

Propose that you pay what you owe according to the law, and if she balks, you have to pay the money to adjust it officially. It sucks.

In most states, if not all, you need to go to court, even if she agrees because the court will need to modify the judgment. If you only have a private agreement with her to pay less, she can come back later for the rest.

Usually, it’s a petition to modify child support, and needs to be based on a demonstrable change in circumstance (such as a lower income). In some states, there is a period of time after the initial divorce decree you need to wait before going back to modify, so check on that if your divorce was finalized within the last few years.

Just because her private agreement with you to reduce child support (if she agrees) won’t be enforceable, it’s still better to try to have her aware and considering it as the standard counter-attack is for her to file a counter-petition to modify parenting time to bump the support back up.

As for exactly what evidence you need, not sure but usually payslips or a letter from the employer indicating the salary or change in working hours / overtime policy are good starting points, not sure you’ll need to wait until the end of the tax year. But these are very state-specific questions you may need legal advice on.

Most states allow a yearly review of child support. Does your child support get garnished from your check by your state? If so you’d need to set up a hearing with your states office of child support enforcement. If your case does not go through child support enforcement, you would have to set up a hearing with family court to have your court ordered support modified. Lawyers would likely be involved at that point.
