Headed to a contempt hearing that my ex wife attorney filed. 1st contempt is failure to pay money to a 529 educational fund. Well I paid the money to the fund just not to her account due to the fact she can take the money out. I opened a new account and contributed that way for my son. Divorce decree states to pay an amount to the 529 plan administrator. The Gerber college fund is the plan administrator not the ex to my knowledge (or others).

2nd contempt is being late on reimbursements for child care. I was order to stop paying child support in September of ‘23, well the child support continued to garnish my wages until January (4 months after the judge order) Paying child support and childcare cost was damn near impossible but I made it happen with a couple of late payments. Everything is currently paid up almost 2 months before the court hearing.

3rd contempt is not notifying her of my sons extracurricular activities in a timely fashion. Sometimes my son isn’t feeling well so we have to cancel his baseball practice or he’ll make up a time at the last minute without notifying the mom because she believes she should be notified 24 hours in advance. Her lawyer is asking for 8 months jail time will all offenses.
