I am in Georgia which is an equitable state. I can tell you from first-hand experience that equitable means absolutely nothing in the end. The judge is just going to divide everything 50-50 maybe you might get 52/48 but essentially it’s going to be 50-50. You could’ve paid all the bills made all the money you will still have to pay 50-50. It sucks but that’s the reality of the situation so basically at the end of the day get ready to pay and move on.

Men usually consider 50-50 to be a win, to women it is a loss.

17 years together, 12 years married, no kids, she didn't work, divorced in WA which is a community property state. So everything was 50/50. That's all assets and all debts. The eX refused to talk about anything until I said fuck it all, will see tou in court. Then the same week magically she agreed to mediation, home sale and we got everything worked out.

Get an attorney if she has one or brings any drama. Get a court date asap. They only reason for them to negotiate and move forward (when they are dragging their feet) is the fear of a judge actually following the law... The judge will still fuck you, but you can predict it; ie it will be what the law requires...

Sole provider - all marital assets halved. Separate property include inheritance which I kept separate and some pre-marital retirement contributions were mine alone.

Arguing you were the sole provider is in most cases NOT going to get you more than half of the marital assets and more likely to get you less than half.

“Equitable” gives Judges latitude in some cases to allocate marital assets differently if wealth was attributed to someone’s outsized talent like Bezos or egregious marital waste. For the other 99% of average American couples - a Judge won’t render judgement on a he said/she said rundown of who contributed what and deserves what. They just take marital assets and split it down the middle.

If you put everything in front of the judge and expect a fair division, there will not be a greater fool than you. In-fact you can call yourself lucky if you get 50%. Have you not read prior posts here? The only way men can hope for anything fair is by concealing, transferring, undervaluing, converting marital property to separate property and fighting for every cent of assets.

Don't waste your time on attorneys, they don't help, hide what you can and disclose bare minimum, let them do the work on discovery

Same situation. Having to take it to a judge. I think you have to leave it to the attorney and just try to be reasonable and respectful of the judge. Don’t be shocked if they present you a reasonable offer in the courthouse steps.

I am in Texas and trying to do 50/50. But her lawyer is making stuff with her to make it uneven. There is always a chance if they convince judge they can get more than 50. It is better for your attorney to lead a way here they know all of this tricks and can help you to be ready.

She worked, didnt worked , you paid all the bills, names on title , not on title, mortgage in your name only , she whored around , she worked part time , you worked 8 shifts at 3 jobs and she slept all day , took care of the kids, renovationed the home and took care of her mother.

50/50 split...regardless ...just went thru it..

She has zero debt ..

So it's never really 50/50 us guys still have to clear our personal debt that someone doesn't belong to her.

Same situation and I’m in exact same boat. Half doesn’t seem fair (especially if spouse has a good job), but I’m told to expect to pay half. I’ll let you know how mine goes if you DM me

In Kansas the only way she doesn’t get half is if you purchased it before the marriage. Even then, she will get half of all the equity that accrued from the day of the marriage.

He won’t care about the distribution of assets that you present to him. I’m not exactly clear what you mean by that, but essentially you and your ex need to work this out or it will go to trial. At that point, he will just have a list of all the assets, and split down the middle. Then decide what goes to who. It’s much better if you and her can get this done in mediation and not go to trial.

Regardless, it’s best that you accept it will be 50% now, and not get any hope that a Judge will see it differently. He won’t because it’s very straightforward.
