In family court the judge basically believes most/all claims the woman makes, even without evidence... It's just the way the family court system works. If the man leaves them the woman will claim the man abandoned the family, which also implies that he abandoned his obligations to the child. Under this pretext the court will look unfavorably against the man, and it's basically impossible for the man to prove he didn't abandon the child. So, the legally safe thing to do is stay in the house until the lawyer can get a temporary support or custody agreement in place explicitly stating why he's leaving the house and the wife signs this as well. Something in writing is critical, because the man always needs physical evidence to prove a claim, as opposed to the woman usually never needs to present evidence to be believed.
