Does anyone know if alimony, being calculated, is linear in terms of money I make vs what she makes? My STBXW could have made almost 200K full time, but despite me telling her for years to work full time she chose to work part time (RN, making 80+ an hour). Then she lost her job. My lawyer told me that in the state of California.. the judge says it's my fault for her not working. Basically the courts don't care why.. I worked making 200K, she didnt for medical and other reasons, and now the claim is it's my fault. #1 reason I tell all men to not get married. If this shit is true.. e.g. I literally told her to work.. work more.. kids are grown.. and she instead lost her job and makes 0.. how in the fuck any logical sense that I am to blame for her not working? So now I am looking at an ass ripping for alimony because she could have made similar to me, but now out of work for 2 years and not really trying despite my pleading to work.. its my fault. Anyway.. OP makes about 1/3 what I was making.. so I am curious if I'd be looking at 2700 a month (max) based on my 10K a month pay vs her 0? At the very least she would be imputed to minimum wage in Cali at about what.. $20 an hour (fast food) or more? So her salary would be considered 40K not 0 I assume? Even so.. though she hasn't worked for over a year, she should be working.. given RNs/etc are one of the most needed positions. So I am wondering how that will factor in to shit.

I know it's calculated and per case basis.. but was hoping someone with similar pay to mine might weigh in on how much I might have to pay alimony.

If she’s remarried, you shouldn’t have to pay spousal support/alimony or get it greatly reduced. An attorney should be able to greatly help you out on that and being California, try to get a female lawyer.

Go to the California child support guideline calculator at this link.

Run some numbers and see what you can expect to pay.

Then, make sure you log what days you have custody of your child and for what hours. They will certainly rerun the guideline at your court date especially if you are disputing her income. Make sure the court is aware of her income and what the actual custody is, regardless of what any prior custody order is. Whatever you guys are doing for custody in real time is what the court will use, unless you guys both agree it will be something different going forward.

You were making $5k a month when the initial guideline was calculated, but what do you make now? You don’t have to share if you don’t want, if you do I can run a guideline for you. Also, they will know what you make if you aren’t self-employed and have a normal above the table job. They will see that in their computer system. Do you know what her new spouse makes? They will add that income in there for tax purposes. If he makes enough to put them both in a higher tax bracket then the calculator needs to know that.

I would also set aside some extra cash, they will set the effective date of the new child support amount to the month of the file date of the motion to modify, most likely so might be good to have extra cash sitting around just in case you have to pay the difference going a couple months back.

California? You need an attorney. And you need a good one and if you can, get a female one just in case because you might face a woke judge so your chances are better with a female attorney on your side because then the judge has to hear your side.

They're right on the lawyer. According to your numbers, the lawyer will pay itself off in like 6 months based on how much better the situation will be for you. Call around, pay for consultations even (when they charge you $100 just for the consultation, it always seems to be worth it), and get a quote just for this single hearing.

Need an attorney. Don't go it alone. The few thousands you save will cost you 5 figures over the long term. There's legal technicalities we're all not aware of, but experienced Divorce Lawyers are.

Prepare a child support worksheet with her new income and bring it to court. Also, get a lawyer bc you don't want to F this up on some technicality, and there is plenty of money you can be saving if this shakes out the right way. The audacity of these women to lie, deceive, and hide evidence in these cases never ceases to amaze me. They have no honor or virtue. No wonder it was so easy for Satan to deceive Eve.
