So some backround, I'm in my mid 40s and have a 13 year old son with my ex wife. 6 years ago I dumped her and divorced her and have my son 50/50 so I do not pay child support and make him a priority in my life.

I live in California. My son and I live in a house together and love it and we travel a lot and have a good life.I lived in an apartment for two years did not work overtime and let her stay in the house I bought for her and pay the mortgage and all the high utility bills and watched her work tons of overtime like I used to. Best thing she ever said to me was “I have this mortgage and all these bills to pay!”, “Welcome to my world”, I replied. Felt so good. I worked 5 12 hour shifts a week when I was with her and now I work 3 12 hour shifts. I make my son a priority and have him 4 days a week. I took her back to court and the court said she made more money than me and that I could actually get child support from her. I refused.

So in order to keep my ex-wife from moving all over the place while we divorced. We came up with an agreement that she would stay in the house with the agreement that she would pay the mortgage and not be late or encumber the home in any way and in return when my son turns 18 we would split the equity 66/33 me getting 33% and she has the option to buy me out. If she did not keep up with her end of the deal then the house would be sold immediately and she would split the equity with me 50/50. My name is still on the title and the mortgage loan is solely in her name. All she had to do was pay the mortgage which she makes more than enough money to as a lead nurse and she would have a house that is now worth $990,000 in five years and she only owed $430,000.

Fast forward 6 years and she took a Covid forbearance on the property and is $40,000 behind on the mortgage and the forbearance put that money on the back of the loan so it would come out of the equity that she would split with me. She told my son, “Your dad doesn’t need the money.” In addition she is always late on a solar panel loan payment and she is currently 7 months late on that. I found this out because the Solar panel company calls my phone on an almost daily basis to tell me she is late. Realtors started calling my house in June offering to sell it and informed me that I was $40,000 late on the mortgage. When I talked to her about it she said she was in a “crisis” and had to take the forbearance. She went on 7 trips last year during her supposed crisis including trips to Hawaii, Mexico, San Diego, wine tasting tours and several other trips. She throws large parties at the house all the time. She is living “her best life” as they say, good for her. I am holding her accountable for “her best life” and trying to rip me off and breaking our agreement.

I talked to older mentors, my closest friends, and people I trusted and they all told me the same thing, “Hold her accountable for once.” So I contacted my family law attorney she said it was a clear violation of our agreement and to file an order for the court to sell the house and split the equity 50/50. I stand to make over $250,000 from the sale. She is getting desperate and offering to buy me out for $100,000 or for me to wait five years when the house is more valuable, and of course she is throwing the whole “this is not good for our son” thing at me. Fellas, women know our weaknesses and if pushed they will threaten to hurt their own children to get what they want but do not believe it. I hope for all of us on this sub that I win in court.
