I'm in a bit of a delimma, but I'm not sure if it applies 100% to me.

I've been living in my house until the divorce agreement is filed, which will spell out what is happening with our house (wife and 2 kids can stay in it temporarily; it is to be put up for sale at the end of January). I was hoping it would be filed already, but the mediator doesn't seem to be in a hurry. It could be a week or two or three. I have no idea.

I am not going to be able to buy a new place to live until after the house is sold, but staying in the house is not optimal. So I'm looking at rentals in the area. Today a house in an adjacent neighborhood has gone up for rent. It's an awesome location for my needs and fits my budget and I want to move on it ASAP. I'd love to be out of my house before Thanksgiving if possible, and this rental is far more appealing to me than any apartment or condo.

Anyway, I'm aware of the rule that you don't leave your house until the divorce agreement is filed. However, I may lose out on an ideal temporary residence if I wait. AIUI, the "don't leave your house" rule is primarily for child custody leverage, but that's not an issue for us. Our youngest will be 16 in the spring and driving, and if I'm living 5 minutes away, she can come to my house anytime easily. We're also not fighting over the division of any assets, now that I've convinced her that the house has to be sold. The house is really the only asset of any great value.

What are the potential issues, if any, if I grab this rental in the next few days regardless of when the divorce agreement actually gets filed?
