Wife and I have been married 25+ years. Last kid moves out this month. Long story, we are still together, but I doubt we make it the year. Can you guys please help answer some questions as I do not have a lawyer yet (since we are still together as of now).
We own our home (one of our 3 major assets, home, 401k, and an apartment building). If I say I am done, how long do I need to stay in the house. I have a camper, and currently have a vacancy at the apartment. Could I move out that following weekend, do a short term stay in one of those two (depending on the weather season), then establish permanent residence a few weeks later or would I need to stay in the house until a separation agreement is made and filed?
Given she has mostly been a SAHM, highest income of $40k (and is currently trying to start her own business), and I make $100k, I assume I am on the hook for permanent alimony, or similar. What I think is reasonable, if not generous would be to offer to pay some of the main bills (house payment, utilities, her car payment, etc. that would be over 50% of household take home when she was working at her last job). That would put her able to pay the rest, and they are mostly expenses she can control such as entertainment/groceries, etc. However, I think that is high in the long run, however the car could be paid off very soon, and keep all major debts that are in my name in my control since I am concerned about her paying them. It would be best for her and viable for me to accept the car payment until this is all worked out, most likely paying it off well before bringing the amount I expect to pay down in line. My concern is this might set a precedence I can afford to pay this amount. Since I am looking at doing this for 20 years, that few hundred a month will really add up. What has been your experience with temporary support?
Especially right after, I expect to be kind of an emotional mess. I would like to combat this by pouring into side jobs, remodel the vacant apartment, maybe even Uber eats or something to make some extra money, so I can pay off lawyers and get a fresh start as soon as possible. Can that extra money I make after I move out be considered in my income, and therefore part of alimony negotiations? In the end even if I walk away with next to nothing, and even 50% of my current income, from my main job, I will be better off than I am now. I just want to be able to combat the debt.
