No she was not inebriated, I believe she was just not paying attention and most importantly, driving too fast as she was in a rush.

The entire front passanger was destroyed, anxel broken and frame damage

She said she was going 5mph, but an impact like that which also took out the entire brick column, had to have significant speed.

You could. Will it be successful? Absent inebriation or driving under the influence of drugs, it is highly likely your allegation will not matter.

How long ago was this? If it was too far ago, then they would argue that you did nothing all these days because you weren’t worried but is trying to use this accident to get a upper hand in divorce. And this argument may work.

On the other hand, if you as much as sneezed a decade ago, it can be used against you !

Was she intoxicated, distracted by the phone or does she have any mental disorder that makes her impulsive, anger issues? If it was a poor reflex accident then I guess it won't be much effective since it could happen to everyone.

Another thing. Most drive thrus have cameras so you can ask for a surveillance video of the crash and see if you can pick anything up from it?

The question really boils down to how she totaled the suv in a drive through……… Do you suspect she was in some way inebriated?

If it happened due to sheer stupidity that’s gonna be a hard argument.
