Depends on the state. Here in VA, even if a parent moves with the kids the courts will MAKE them move back if they are held in contempt and/or it is not in the best interest of the child. VA is an equal parenting state (meaning they dont just favor the moms though it does come into play at times). You also would need to do your due diligence and make sure a contempt of court is filed and have plenty of evidence.

I’m in CT and the first weekend after my wife divorced me she took the kids out of state to her family’s house who I didn’t know but I do know her cousin is in jail for murder and I don’t have any way to contact them or even what the address was. I should have called the police as soon as I realized they were missing but she did tell me where she was going the morning she took them. Unfortunately I am disabled and can’t drive due to extreme brain damage.

In your case, do you have a court order specifying parenting time and custody? Is the mom regularly violating the court order, taking your children to undisclosed whereabouts for up to 72 hrs in which nobody, and I mean nobody knows about?

If the mom is taking your kids to her house, but the kids are still attending school, and their daily routine isn't impacted(except of course not being with their dad when they should be), and to an extent you are aware of their whereabouts, it wouldn't be considered kidnapping but rather a violation of the court ordered parenting time.

Document. Record. "One offs," the judges may brush off. But an accumulation of court ordered parenting time violations will have a bigger impact. As always, speak to a lawyer!

Yes, they will go looking for a parent that kidnabs their child. Amber alerts are almost always these situations.

It becomes a greater concern when the parent is suspected of crossing state lines or could flee internationally.

If your ex disappears with the kids, definitely file a police report every single time. Even if they don’t do anything, you want a record. It couldn’t look worse for you than “Well, the kids are supposed to be in my custody, but I haven’t seen them for days. I’m sure their mother has them.”
