Wow. What a fucked up case! If anyone should be in jail it's the ex-wife. This case is an outstanding example of why judges should be restricted in how long they can jail someone for contempt of court. If police can only hold you for 2-3 days without charge, whey can judges sentence you to months/years in prison just because they feel like it????!!!!

I'll play judge and lawmaker for a moment. This is how I see that it should go. In cases where the biological father is not known, the de facto father pays child support, because at the time paternity was not known. Once paternity is proved, the de facto father is no longer legally required to pay and the biological father is required to produce the continuing payments. No sort of repayment will be made by any party because this causes undue financial stress. The de facto father may continue to contribute money to the welfare of the child, but this is not required by law. The mother committed fraud by accepting child support payments which she new may not be legally owed to her. She also committed perjury during the divorce proceedings that consequently falsely put the de facto father in charge of child support. She should serve a certain amount of jail time (say 6 months?). During this time, a new custody hearing for the child should be held where the de facto father (as previous caregiver and invested party) and the biological father have the option of claiming custody. Let us assume that the de facto father claims and is granted custody. In that case, the mother and the biological father would owe the de facto father child support. The de facto father would still owe the mother alimony as state law does not seem to consider fault in the divorce proceedings.
