Wrongfully convicted of rape and incarcerated for 17 years, a man owes the state $111,000 in child support for the time he spent behind bars. Inevitably the State will return him to jail for the child support debt he couldn't pay because the State had falsely imprisoned him.

This is the insanity of the Bradley amendment just passed into law in Australia as the "Other Measures" of Gillard's family law "reform". God help us.

But of course in Northrop’s case, there’s a problem with that concept. Northrop was a responsible dad before he went to prison, and the state put him [in prison] for a crime he didn’t commit and never confessed to. In other words, it’s the state’s fault that the state is out the money it paid to Northrop’s wife.

But to the state, that makes no difference. It paid his girlfriend and he’s required to pay the state. Period. Ironically, responsibility for his inability to support his kids doesn’t matter.

Of course that’s not the only thing the State of Washington doesn’t take responsibility for. It also doesn’t take responsibility for wrongfully convicting a man of rape. Unlike many other states, Washington has no scheme to compensate the innocent who are convicted of crimes. ... [Northrop] not only has to pay the state $111,000 that it never would have spent if it had jailed the right guy, but it refuses to do the honorable thing and compensate him for the 17 years of normal life he whiled away behind bars.

Simple as this, DO NOT PAY, his life has already been ruined, what else does he have left to lose, no one would blame this man if he went postal.

The system has chewed this guy up and spit him out for no reason AT ALL.

This is beyond awful, this is a new level of unjust.

All in all, at this point in his life, given the circumstance he has two realistic reasonal options.

A) flee the country and hide out in some south american shithole, and live his now wasted life in utter anonymity and poverty.

B) find someone, somewhere, a rich, powerful sympathetic ear to turn this against the state. Whether there is an individual or an organization that even exists to support him I don't know.

If I were in his shoes I'd be leaning towards option A.

God knows the system won't bring him any justice.

edit: yes, it is.

The state Department of Social and Health Services has a program for forgiving child support bills in hardship cases, and it waived its share of Northrop's balance in November, within a few hours of receiving an inquiry from an Associated Press reporter. But Northrop still owes tens of thousands of dollars to his former partner, and the state is garnishing his wages to the tune of $100 per month.

The good news is that if there isn't a mechanism for recuperation, it does not prevent him from suing the state. It will take longer for a possibly larger pay out.

Though how this will happen if he's behind bars for being so far behind in child support, I have no idea.

He should sue the state for the balance of the prevailing wage he should have earned doing the work that prisoners do for pennies an hour in prison.

The state was unlawfully enriched for the work that he did without being paid the prevailing wage for it, and that difference should at minimum, cover the costs they're talking there, and possibly give him some money on the back-end, too.

Of course, they'll fight like rabid dogs not to have to pay for it, because that's just how it works.

This is, excuse my words here, fucking bullshit! 9 years to order a DNA test and get it back? He could have gotten out, 17 minus 9, in 8 years if they did the test in a couple of weeks which seems reasonable. It is bad enough this man had to sit behind bars for as long as he did but waiting for a DNA test for 9 years... I would sue or something, perhaps get a law passed to prevent these sorts of things. I wonder how many people are behind bars wrongfully! Injustice I say!!

Sue the accusatory for the same things and pay the state with state money, job done.
