it goddamn should be!

the reason it's considered rape if a man removes a condom without the woman noticing is because the court declared that met the threshold of lack of consent. the woman only consented to protected sex, not unprotected. if i, as a man, am only consenting to protected sex too (her being on the pill), than how is her going off it without my consent or notification any different? it's not! this is just one more example of court bias against men.

According to court precedent, no it is not. A woman can even take sperm from a condom and get child support from the father.

What if during intercourse a woman removed the condom without the man knowing? I'm not saying it wouldn't be noticed...but it is a possibility.

The way they define rape is by penetration, so vaginas can envelope by force, but it will not be called rape. Thats why the rape figures are skewed, they don't most the female perpetrated rapes.

It should be, but being the devils advocate here, the argument against it is probably as follows.

It should be the choice of the woman to get pregnant. If a man takes off a condom, then he is taking away that choice. If a woman stops taking the pill, she is making a choice for herself that she get pregnant, and it isn't causing any change or violation of rights to the man (if you assume the women takes full responsibility of the child, HA)
