I don't understand the "rationale" that harsh penalties, or even the enforcement of existing laws against false allegations will somehow deter true victims from coming forward.

If an alleged perpetrator isn't convicted of a crime, it does not necessarily means that he/she is falsely accused, or that he/she is factually innocent. It merely means that there isn't enough evidence to prove the case beyond a reasonable doubt.

For an accuser to be found guilty of anything, whether it's perjury, criminal defamation etc, not only must the allegation be proven to be factually false, deliberate malice is also a crucial element that must be substantiated beyond a reasonable doubt. It's incredibly challenging to prove so, and proving so indicates that the accuser is the reprehensible party, so how is punishment for factually substantiated criminal conducts and justice for victims of utter vileness unreasonable by any standards?

I argue that having/enforcing tough repercussion against factually proven false accusations is actually beneficial for true victims. It discourages bad actors and in turn lends credibility to genuine victims.

This is NOT a victimless crime. An arrest record (charges dropped does not erase the arrest record) it is permanent, and can be accessed with a professional background check. That can prevent a man from getting jobs, renting, adopting, coaching sports and more. I hope you are never victimized for you to know first hand why accountability is nescessary.

It is very strange situation: the only proof is the word of supposed victim, if she admits that she lied, there is no proof and he is free (after 30 years spent in prison).

As to the "don't punish for false allegation to let them tell the truth after 30 years of silence" - ok, it might save a few innocent men rotting behind the bars. But much more men will be falsely accused once there is no prison risk for women lying under oath.

It's fraud, perjury, interference with law enforcements, obstruction of justice... Just making a false report to law enforcement is a misdemeanor, if the report results in injury or death of the accused, it's a felony.

It's a crime, and should be treated as such. The only reason this is even a question is the prevailing narrative of women sex crime accusers as de facto 'victims'. But they are only victims if the alleged crime actually occurred, otherwise, the accuser is actually the criminal. No lenient special treatment on account of the sex of the false accuser. There's enough of that BS in our criminal system already. And no lenient special treatment on account of the the false accusation being of a sex crime. Think of it as the 'sex crime' version of swatting.

The fact that filing a false report is a crime, doesn't appear to have the effect of discouraging victims of any other types of crime from filing a reporting... why presume it would have any such effect on sex crimes?

If any person, male or female, lies under oath to get someone else arrested and possibly incarcerated, of course that person should be arrested. How is this even a question? Their crime has no bearing on what others do or don't do with that knowledge. You should be thinking only of the matter at hand.

If they have something to gain and nothing to lose by making false accusations, that will incentivize the making of false accusations. There must be severe consequences for this. False allegations should be considered sex crimes and punished accordingly, sex offender registry (so men can know to protect themselves for these women) and long jail sentences.

The problem with your idea here is it would further encourage women to make false accusations because they know that if they come forward literally nothing will happen to them where as the man they falsely accused could have spent 10+ years behind bars.

I agree with the idea of placing them on a public list equivalent to the sex offenders list and having THEIR reputations stained for the rest of their lives..
But to be honest if the courts put a man away behind bars due to a false accusation and false evidence then the man MUST be compensated for that.. taking into account:

Physical / Emotional harm done to the man
The destruction of his reputation / good name
Loss of Job / career / advancement in said job / career
Loss of income he could have made behind bars.

All of these factors need to be weighed and appropriate monetary compensation paid out to him.

I'm sorry but you aren't likely to find many if any people in this sub who will agree with you on the idea of granting immunity if they come forward to tell the truth... Any woman who makes or has made a false accusation had PLENTY of time to tell the truth.. why should they get off without consequences after ruining a mans life?

If the focus is on old false convictions and encouraging women to come forward and confess, perhaps an amnesty would be a good idea: whilst it doesn't punish the women, it does potentially relieve the men of suffering and provides an incentive if the penalties for subsequent discovery of false accusation after amnesty ends are severe.

The truth is, being raped feels as bad for women as being cucked feels for men. They are crimes of an evolutionary nature. When a woman is raped you're removing her right to choose who to mate with. Rape sucks, but as someone who has been raped, the simplest way to describe it is it feels like losing a physical fight with an added disgusting emotional flavor. A lot of women will try to make being a rape victim into their entire identity. What's the stat, like 1 in 4 women are raped? Maybe I'm just not sexist but I don't think 25% of all women are broken human beings so clearly there's usually not much real psychological damage. To reiterate I'm obviously not pro-rape. I'm saying that rather than punish women just as harshly as we currently punish men, let's punish men as lightly as we currently punish women. For most women, rape accusations are about retribution. If she goes to court and the judge says the man is guilty, that's usually all she's after. Social validation. Maybe money too. Take the rapist's resources without his consent for the woman's benefit. If the rapist did crimes in addition to rape, such as assault, kidnapping, or battery, charge those as separate crimes and punish accordingly.

When a woman gets caught in a false accusation, garnish her wages in the exact same manner you would have done to the rapist. That way everyone can have their vengeance without destroying anyone's life for what's more often than not just bad sex. I guess I'm saying this should be a special kind of civil case, rather than criminal. The "victim" would demand a sum of money, and if she gets caught lying she has to pay whatever her "wager" was. That potential risk is enough to dissuade the less serious accusers.

Fines are at least better than the current punishment method. How does it make sense to put rapists in a prison where rape happens constantly? The guy will only grow more accustomed to rape in prison. It's highly likely he'll get raped in there which will likely make him think it's more okay to rape others. If he survives prison, then he has to live on the fringes of society, another situation that increases the likelihood of rape.

In any case, the punishment needs to be equal for the rapist if the accusation was true and the accuser if it was false.

You use the word "lying" or "liar" a lot in your post. I believe those make up only a tiny fractions of false accusations. As a result, the best way to reduce false accusation is through education, not penalization.

Yes, in the rare case of a malicious, completely fabricated false accusation where the women concocts a story to "get" the guy, it should absolutely be prosecuted. But if you think there are tens of thousands of those types of accusations reported to police in the United States each year, I think you're mistaken.

The far, far, far more common false accusation is the mistaken woman who may just make the accusation in a social setting. The woman who has been so indoctrinated about "enthusiastic, ongoing consent" that she honestly, genuinely believes that she was raped when, in reality, she had consensual sex. The most common is the woman who had a couple drinks and believe the feminist bullshit of "drunk people can't consent". But it could really be any form of regretted consensual sex that she (or her friends) can twist in their minds to not be really consensual.

Those cases could be avoided through better education. Unfortunately, feminists - and now colleges - continue to spread misinformation about consent. So, like many men's rights issues, the first step is fight back against the feminist propaganda to at least keep the situation from getting worse. Once we have stopped the runaway train, we can start working on reversing it.

Same here. Prosecuting crimes, visibly and strongly, discourages some people from committing those crimes. Will it discourage some false accusers from admitting it? Yes. But if you DON'T prosecute them, you encourage many other women to do it because, "Hey, there's no real downside to doing it".

It's a tough issue. Like you mentioned, if the penalties are too high, they may be hesitant to admit they lied, and innocent victims will not be released.

One solution could be to have a higher penalty for cases when someone is proven to have lied through other means, but a lower penalty if they come forward on their own.

Right now the main problems are two:

There's no serious punishment for false rape claims.
False rape claims can be abused easily because the burden of proof in these cases is given to the man and he is guilty until proven otherwise.

Fixing 1 would make liars keep lying because it would be their only choice, but still some would go for the trouble if they find it worth the damage inflicted.

A healed system would require the burden of proof from the accuser, as it must always be.

No more arrests because of a claim, you just can't give people the power to verbally get somebody arrested.

It’s already a chargeable crime (lying in a sworn statement/ complaint), and a civil offense as well (defamation). Good luck getting the police to do anything about the first, but filing a tort claim for defamation is serious business. One should find a male lawyer with a reputation and demand extensive social media discovery. (I do not know this just from theory.)

Could you imagine how horrible the world would be if admitting to a crime would grant no punishment upon you ?

Women already get off almost scot-free for false rape accusations, if anything the punishment should be much harsher and maybe they would think twice about throwing such accusations in the first place.

Imo women make false rape accusations because they know almost nothing will happen to them and everybody will believe them.

Now I do believe if she admits to the crime before she is caught and she shows genuine remorse then her punition should be lighter but she should still be punished nonetheless and make amends to her victim.

Should friends / family be arrested for making incorrect accusations?

Because not all ‘false accusations’ come from the presumed victim, if anything a majority are actually from relatives, friends or family members

So... should these people be arrested for worrying / fearing the safety of someone close to them? The exact same legal consequences apply, and socially the issues align

What about if an accusation doesn’t have enough proof, do we then assume it was a false accusation and punish the presumed victim for coming out?

Is it really a good idea to punish accusers in any capacity when keeping in mind how potentially damaging it could be to genuine victims and the likelihood they report the violation? (Added to the already depressingly low number of people pursuing legal action for sexual assault)

And then I can also be an issue of how you differentiate between malicious accusations and genuine ones, which is almost impossible to actually do, and therefore a silly thing to try and enforce

All the original question does is bring up more, harder to answer questions with important consequences, something seemingly overlooked in favour of shallow, reactionary takes which you see all too often on this sub
