Interesting findings for sure. I wonder whether and how the judge's age factors into the equation. I'd hypothesize that older judges are male to a larger proportion and thus the difference in judgments between the sexes could to a certain degree actually be a generational effect.

if that hypothesis was indeed valid, it'd would imply that in addition to adding more female judges, time (aka older judges retiring) would be a relevant factor.

Another factor that I'd put up for contemplation is 'female ingroup bias' which would predict the opposite effect compared to the one found in the above study which is what led me to consider the above stated alternative/additional hypothesis.

The real problem isn’t judges, it’s gynocentrism and the idea women are less responsible for their actions than men. In Great Britain, judges were actually told to show more mercy when sentencing women criminals. (1). In the U.S., we have feminists advocating we should stop never be sent to jail for anything(2). It’s these attitudes and practices that are the root problem and what needs to be addressed most.
Observed differences don’t mean cause-effect. If we compared the sentences handed by judges with blonde hair vs judges with brown hair, I guarantee there would be some difference, but it doesn’t mean hair color is the reason for the sentencing difference. It’s the same with the judge’s sex. All the cases are uniquely different, so it’s a leap to assume the sentencing differences are a result of the sex of the judge. The author says “I interpret this as evidence of a paternalistic bias among male judges “ That’s simply biased speculation on the part of the author, which really shouldn’t be included in an abstract in my opinion. The sex of the judge isn’t the only variable. There are all sorts of variables between the different cases which could account for the sentencing difference.

P.S. I remember reading a study sometime ago showing female surgeons had a higher success rate, some claiming this proof female surgeons are better. A closer look at the data however showed that it was mostly more experienced male surgeons who were taking on the riskiest, most challenging surgeries, therefore having a lower success rate. This could very well be the same sort of thing.

A woman's vulnerability - real or feigned - is often more likely to factor into a man's judgement when exercising authority over her than it will that of another woman. This is not always the case, but often if someone's going to see through a woman's shit, it's another woman. If someone's going to recognize that even real vulnerability doesn't excuse her criminal behavior, it'll often be another woman. Men are so programmed to be gentle with women and treat women like we're special that when a woman is unethical, it's hard for a man to put the brakes on that treatment in order to hold her as accountable as he would another man. However, female judges might not always be as good for male IP & SV victims whose perps are female, because sometimes that in-group bias that women have can combine with the duluth model training the judge has been required to go through to prevent her from having any compassion for the victim... especially if the abuser is trying to excuse her actions by using false allegations of abuse.

Also, if a female judge is feminist, it's almost a 100% guarantee she's going to be even more biased in favor of women than a nonfeminist male judge with duluth model training might be.

That's interesting, assuming that a judge has to remain impartial throughout the trial, and base judgment on the evidence presented, theoretically it shouldn't matter if it is a woman or a man judge.

This will need some serious research into convictions by gender, time of the conviction based on individual judges, and length, which that extract doesn't show.

I'm not even sure if such research is possible without going into serious academic-level studies.

There should be no problem with more female judges. Plenty of male judges are responsible for the horrendous anti-male bias in courts. Impartial and fair judges should be appointed, regardless of gender.

Judges are judges. They care so deeply about the law. There’s nothing to actually make them inherently biased unless you think the gender disparity hatred is biological…which like - what biological incentive does one gender have to hate the other.

I have a preference for female judges for female criminals and have lobbied local state MPs about barring male judges from cases involving violent/abusive women. Women are better able to see through the emotional claptrap of other women. The male judges too often get sucked in by the female perpetrators' tears and damseling.

We need to implement mathematical sentencing.

Judges should use a tool like a spreadsheet to calculate sentences. All the facts of the case, and the offender's criminal history, would be entered into the spreadsheet and it would output the sentence.

The formula should be open-sourced and publicised. If politicians try to add sex of the offender into the formula, then everyone would know and we'd have to push back.

If sex isn't written into the formula, then we would have gender equality in sentencing. Bias would have been removed.
