I am asking in part after reading Amy Schumer's Ms. Gala Speech, which has sparked a considerable deal of controversy. This may not have been what happened, but I got this impression that she went to a drunk man's place while sober and basically let him have his drunken way with her without stopping him.

Regardless of whether this is accurate or not, it still makes me wonder about your reactions to such a scenario: If a sober person simply does not prevent a drunk person from engaging in sex with them without actively encouraging it, is the sober person raping the drunk person?

Personally, I would strongly encourage people not to put themselves in such positions (from either end), and feel that there may be some responsibility on the part of sober individuals to help protect drunk people from harming themselves or making poor decisions. However, I don't think it constitutes rape if you simply don't get in the way of a drunk person doing whatever it is they're trying to do. Similarly, I wouldn't consider a person a murderer simply because they didn't stop someone from shooting someone else when they could have. Thoughts?

A further question: If drunk person forces him or herself on a sober person sexually, is he or she now a rapist?
