fuck politics; this guy is a scum for getting someone pregnant without their consent. If he is wearing a condom every time they have sex, she should at least feel mostly secure she will not get pregnant.

We freak out about articles where the woman sperm jacks men and gets pregnant by it (the cum in the mouth girl comes to mind), and rightfully so. Taking steps to prevent contraception from working should not be tolerated.

The difference here isn't legal.

It's that a woman would have never admitted it. That was his 'mistake.'

Although anyone who does this should be locked away for good or sterilized. I'm just explaining why it looks as if it's in favor of women in this story.

As far as law goes, if this guy is convicted, it could set a precedent for future cases. Men will have an accurate case to compare their situation with, should this man be found guilty.

This could be a big deal. Having a court judge claim that the defendant whom poked holes in condoms, actively prevented contraception when the parter believed she was participating in safe sex, sets a clear standard of sexual assault.

Yes women still will game the system, and this situation will still be unfair. But compared to "just getting fucked" in a situation where this occurs, citing this case would be a much better defence than "she's a crazy bitch and this is unfair".

What people don't realize is that having to pay child support is a deterrent to this exact behavior. Would there be a financial opt out clause for child support for the male, this behavior would be on the rise.

I'm not sure the point or the post? That dude deserves the guilty hammer, I believe this precedent would apply to women as well. Keep in mind that this is in Canada. I can't recall any cases in Canada prior where the genders were reversed and the woman was found not guilty.

Sorry but if a woman is lying about being on the pill or whatever then she's equally as guilty as this man. You know unless she's going to raise the kid herself without ever asking for a dime of child support.

Really women should be charged with sexual assault if they lie about utilizing their contraceptive options to become pregnant because it is effectively fraud.
