I was the very first person to email them about this (I started the thread on the topic too) and I received exactly the same type of aggressive response. In other words, they're not flipping out after being contacted numerous times, this has been their exact attitude right from the very start.

One thing I'm not sure of, if this is 100% illegal, without the shadow of a doubt, do you actually need to sue? or can you not simply report the illegal practice to the Police and get them to handle the case?

So what can be done? According to Samantha Mangwana, partner at law firm Russell Jones & Walker, not a great deal. “Sadly, although this is unlawful and contrary to the specific guidance in the Act, [it is] left to individual victims of discrimination to enforce the law.” Individual men would have to challenge the club’s practice and take a claim to the county court. “Reality is that most people simply would not bother taking a claim”. She adds that this system is highly unsatisfactory, and that “publicity is the most realistic practical way to make a difference”. Sue Kelly, of the EHRC, said “although the practice is unlawful and challengeable, when it comes to taking action we question the impact door policies have on peoples’ lives. While it is something we would like to address, our resources can only stretch so far.” However, she added that “if we were presented with any advertising or written evidence that a club was disproportionately favouring women, we would write to the venue immediately, which normally results in a change of policy.”

So (1) be in the UK, (2) grab the ad, or make a hard copy of it on paper and then (3) put it in an envelope and send it to the EHRC at this address:

Or you could try an email or their web site but it sounded like the woman was decidedly in favour of ignoring the issue.

If that does nothing, someone needs to sue, which is a lot of hassle but at least is guaranteed to work. You do however need to have actually applied for membership and been discriminated against (ie refused the lower rate) or be a member. My guess is that if a man demanded to pay only the lower rate they would make an exception for him while trying to continue to con other men illegally.

The other day there was a case where a male employee of a hospital objected to sexist instructions that only men had to try to fight the fire during a fire drill. In response the hospital said he didn't have to do it - but the other men still did. This is to try to prevent standing to bring a lawsuit.

Just FYI the EU courts in relation to EU directive 2004/113 specifically state that the penalties will carry with them a punishing amount in damages to deter future behaviour/cases.

these people really are fucking retarded, if someone actually challenged this they would win so easily and would quite easily bankrupt the gym.

if you look on their facebook, it does seem to be a primarily female gym. when i first saw their prices, i assumed they offered different services to males and females. after looking through their facebook photos it appears it's just a normal gym, but they are marketing themselves with some kind of female-pandering gimmick which i guess involves giving women special privileges. it's like a "girl's club." you know, no boys allowed. and the owner is a man, obviously. guess maybe he's just trying to keep his sexual competitors out of his gym.

Why? Why are you bothering with them?

I think businesses should be able to choose their clients, just as we choose the businesses we want to deal with. Why shouldn't they be allowed to charge more? Or even deny service completely? Why shouldn't they be able to do so based on a person's race, religion, sexuality, gender, etc?

Who wants to associate with a bigoted company like that? Why are you jumping through hoops to be able to give these people your money?! Screw them, take your business elsewhere! Why can't people sort this out with their wallets rather than involving the bloody government to do your dirty work for you?

And if the gym doesn't go out of business for being openly sexist, then evidently there is a market for such a business and that is the problem.

This is crazy. Stop trying to give them money, run in the opposite direction!
