tl;dr - I might end up in jail for finally taking a stand

I'm tired of the glares I get when I am at the McDonalds playhouse with my daughter.

I'm tired of being labeled a perv when I have the short-sightedness to purchase clothing for my 5 year old daughter when she isn't present. God forbid she needs new underwear...

I'm tired of the family law system viewing me as a second class citizen.

I'm tired of watching commercials and sitcoms that show men as inept, sub-par being who's only goals are to get drunk and laid. Just kidding, I don't watch TV anymore.

So back to the tl;dr. What is bringing all of this on?

Fair warning. This is about me taking my daughter to church. I know how reddit feels about practicing Christians. If you would like, you can substitute 'church' for 'Disney Land'. Same idea. On my parenting time I would like to take my daughter somewhere, and my ex is telling me I can not.

5 months ago I filed paperwork to have child support lowered due to a change in my income. When my ex-wife was served with this paperwork she informed me that my daughter can't go to church with me anymore. This, despite the fact that my daughter had been attending services with me for the last 3 years. Despite the fact that she enjoys it and has some great friends there. It was a bald faced retaliation of "Well, you are pissing me off, so I'm going to interrupt your parenting time."

For 5 months now, I have bent to her will. My ex picks my daughter up before I go to church, and I pick her up when I am done, despite it being an interruption falling right in the middle of my parenting time. For 5 months I have been a complete mangina.

Last week I informed my ex that I would be taking my daughter to church, as the judge hasn't ruled either way. The judge simply told us to compromise and if we couldn't compromise, then to schedule a hearing. There was no attempt to compromise on her part at all. I would setup appointments with mediators and she would cancel them. After informing my ex of my intentions, she informed me that she would call the police. Being the mangina that I am, I backed down again and told my ex to pick my daughter up on Sunday...

This week I attempted to file paperwork with the courts (just as the judge said we should do if a compromise couldn't be reached). Here's how that went...

Wednesday - Told by a clerk of the court that since the judge never said I couldn't take my daughter to church, go ahead and do it.

Thursday - After reviewing the original decree, I decide I'm not comfortable with the above advice. The exact wording is "Joint Legal Custody. It is in the child's best interest that Petitioner and Respondent be awarded joint legal custod of the minor child with Petitioner (mother) being designated as the primary custodial parent.....and for decisions in the areas of education, health care and religious training are designate. After due consultation with Father, if any dispute, Mother has final decision making authority."

So I wasn't sure. I filled out what looked to be the proper paperwork to request a modification. BZZZZZ. Wrong paperwork. Did you know that a clerk of the court can't tell you what paperwork you should fill out to get done what you want to get done?

Friday - Try again. Fill out a different form. Wrong again. Leave dejected. Get back to my office and call the law library. Guess what? The law library can't tell me what paperwork to fill out either. Their suggestion is for me to hire a lawyer to simply tell me what form I need. Fantastic! Good thing I've had this $6000 just sitting here!!

Humor me for a minute and reverse the genders. If a woman had walked into a court room asking what paperwork she needs, you can bet there would be 4 non-profits and a state agency tripping over themselves to make sure she were put up in a shelter and someone filled out and filed the paperwork for her, free of charge of course.

So from here, I'm taking my daughter to church with me on Sunday. My ex will call the police. I have no doubt in my mind of this, she is completely crazy and will stop at nothing to ruin my relationship with my daughter. Whether they take her seriously or not, who knows. I don't care. The system has failed me and I'm done playing the game. If I wind up in contempt or whatever, I don't know, jail? A fine? Lose any visitation that I have now? I don't care anymore, I'm tired of being walked all over and society saying "Well, that's just the way it is." I'm making my stand and come what may.
