I'll keep note of this in my law class if ever the topic of rape comes up. Especially since I'm in Canada. It's a good point, though. What about sex and violence are different? Why can someone meaningfully consent to one while drunk, but not the other? Either we let drunk people get away with fistfights, or we stop putting men in jail for rape just because he had sex with a drunk woman. I'm sure we can all tell which of the two options is more reasonable.

Always love how the FemNazis come in and tell us all how we are morons. The article brings up a good point and one that has been debated a good deal lately.

I read a case study about a guy and a girl at a party. The guy's friends got this girl drunk and he took her home because obviously she couldn't drive. Gets her home she goes brushes her teeth, takes a shower and then asks him to stay the night even though he was going to leave. They end up having sex, he leaves in the morning while she is still asleep because he has to go to work and leaves his number and everything because he liked the girl. Girl wakes up sees his number, calls him, he tells her what went down and she calls the cops and gets the guy arrested for rape. They go to court, he is found guilty, 15 years in prison.

Basically the court found this guy responsible not only for this woman's ability to consent but also responsible for her alcohol intake. It didn't matter that when he took her home she went through a normal routine of brushing her teeth and taking a shower. Even though this took place in Alabama the law is fundamentally the same where the intoxicated woman is not to blame.

Women are always saying men get more rights and are treated better by the law, not so in this case and many similar interests. Simply buyers remorse in this case to me but apparently a jury didn't think so nor was the law fair in this case.

If i drink and have sex i am not responsible for my actions. If i drive home should the other sober drivers on the road get arrest for not avoiding my car as i enter their lane?

Being a victim of rape (aka unconsensual sex) is not a crime. Assaulting someone is a crime. Drunk driving is a crime. Getting fucked up and murdering someone is a crime. It really appalls me that you can't seem to grasp that simple concept.

This isn't what this law says. Stop buying into feminist bullshit and realize that the legal system in terms of ratified law is at least mostly just.

A person cannot legally claim rape on the basis of their drunkenness. This is not the law, will never be law, and if it was the law, expect it to coincide with prohbiition.

The law in Canada is that I cannot rape someone and use 'well she clearly wanted it as she was getting drunk around me' as a defense. That's it. That's all this says.
