Just a heads up -- you don't need STATISTICAL evidence. You're trying to argue the valid point that the scenario is possible. All you have to do is find a story where that has happened. That shouldn't be nearly so difficult.

Send her to False Rape Society and point out all the cases where the man and woman haven't even had sex. Even if he is eventually acquitted (no sure thing) his life is basically ruined due to society's "guilty until proven innocent" policy for men.

Why would you argue this with her? You're basically saying that she's a horrible person, with no moral fibre.

How would you feel if she told you that if you got angry you could rape her? It's pretty much the same argument, unless your size differential is such that you are physically incapable of overpowering her.

Here are some studies.

As reported by "False Rape Allegations" by Eugene Kanin, Archives of Sexual Behavior Feb 1994 v23 n1 p81 (12), Professor Kanin’s major study of a mid-size Midwestern U.S. city over the course of nine years found that 41 percent of all rape claims were false. Kanin also studied the police records of two unnamed large state universities, and found that in three years, 50 percent of the 64 rapes reported to campus police were determined to be false, without the use of polygraphs. (Kanin, incidentally, was a feminist icon whose work was cited and relied on without question by feminists, including the infamous Koss Report. He suddenly became a nitwit who forgot how to do research when his studies upset the narrative of the persons who dominate the public discourse about rape.)

In addition, a landmark Air Force study in 1985 studied 556 rape allegations. It found that 27% of the accusers recanted, and an independent evaluation revealed a false accusation rate of 60%. McDowell, Charles P., Ph.D. “False Allegations.” Forensic Science Digest, (publication of the U.S. Air Force Office of Special Investigations), Vol. 11, No. 4 (December 1985), p. 64. See also, "Until Proven Innocent," the widely praised (praised even by the New York Times, which the book skewers -- as well as by most other major U.S. news sources) and painstaking study of the Duke Lacrosse non-rape case. Authors Stuart Taylor and Professor K.C. Johnson explain that the exact number of false claims is elusive but "[t]he standard assertion by feminists that only 2 percent" or sexual assault claims "are false, which traces to Susan Brownmiller's 1975 book 'Against Our Will,' is without empirical foundation and belied by a wealth of empirical data. These data suggest that at least 9 percent and probably closer to half" of all sexual assault claims "are false . . . ." (Page 374.)

Just look at Dominique Strauss Khan...The case has gotten international publicity, and the accuser was paid money to seduce him and press charges. Ruined his life with nothing but her "word."

As for what imfamo said, that's bullshit because DSK didn't even had vaginal sex. They allegedly had "coerced oral sex." How the hell can you do a rape kit on that?

Considering 95% of rape cases that HAVE hard evidence are still thrown out of court (i.e recent NYPD rape case); if there is NO evidence it would be next to impossible to convict just because a girl "was angry"...just take into account everything that is used to convict a person: witnesses, lie detectors, semen samples, etc...and even with this evidence cases are usually thrown out of court because she was accused of being a slut, or he was able to afford a good lawyer, whatever...trust me, women do not have the upper hand when it comes to rape trials.

What state/country are you in? Check if there are rape shield laws in effect. If so, you're not getting a fair trial.

Physical evidence isn't needed in most rape cases to get a conviction. Many people come forward weeks or months after the event takes place. At that time the physical evidence can't be retrieved for DNA comparison. At that point most cases go towards he said she said. The problem is, the accused has to prove the event didn't happen. The prosecution though has to prove that the person had the ability and was in the area.

False rape society is the only major source that I know of that actually tracks the cases involving false rape claims. Most studies have conflicting results and may be tainted by political biases.

Just rape her, then when she does go to the cops make sure there is no evidence, she'll accuse you anyway, you'll get arrested anyway, and your argument will be airtight. (not really).
