She has no idea if she slept with him or not, not to mention from the (vague) details she does give that it sounds more like a drunken hook up she regrets (that is if anything did happen.)

Waking up half naked does not indicate you've been raped. She has no idea what happened at all at any point, apparently. So she instantly thinks she's been raped? Sounds fair.

In the case of R v Woods [1981], the accused pleaded that he was so drunk that he had not realised that his victim had not provided consent. Section 1(2) of the Sexual Offences (Amendment) Act 1976 states that if a jury has to consider whether a man believed that a victim was consenting to sexual intercourse, it must have regard to the presence or absence of reasonable grounds for such a belief, in conjunction with any other relevant matters. The Court of Appeal held that intoxication was not a ‘legally relevant matter’ in this context and therefore the jury must examine the other evidence and disregard the evidence of his intoxication.

That argument cuts oh so swiftly both ways -- I could just as easily (and justly too) say that a good woman doesn't get drunk enough that she blacks out badly enough she can't find her way home. ESPECIALLY NOT ALONE WITH ANOTHER MAN. She can't claim innocence here -- she took a deliberate (even if unconscious) logical chain of steps that ended up in her fucking around; in my experience, cowardly women who want to fuck around (consciously or not) will do exactly what she did, so they can claim they are innocent.

Hypocrisy: the art of making rules up, subjecting everybody else to said rules, and then bolting for the door the minute someone awake enough says "Wait... didn't you just say that...?"
