Is No-Fault divorce detrimental to men?

I'm not sure divorce ever favored the 'not at fault' party.

It's always favored the woman.

I remember watching a 1950's Twilight Zone and the shrill wife was threatening to take everything from the husband if she did not get what she wanted, but then the husband unexpectedly stepped into the Twilight Zone.

No-fault divorce on it’s own would be gender equal. The problem is divorce law and family law is biased in favor of females. No-fault divorce makes it easier for women to take advantage of these biases.

The underlying problem isn’t no fault divorce. The underlying problem is women are favored in divorce.

I think what's truly detrimental to men is our collective lack of political will to agitate on our own behalves to change laws, expectations and attitudes. Women have been all over that for decades. They are the Roman legion to our barbarian horde. Hell, we're not even a horde, we're a meekly submissive Germanic village that pays its tribute annually as well as whenever the Empress decides she wants more, which is every single day. We'll give up anything to avoid a fight. We're pretty lame these days. Doesn't have to be that way but we sure are stuck right now. Should that change, my God, man, we can do anything we want.

No fault divorce does make it easier to get a financially and socially ruinous divorce, but looking at the era before divorce was so easy shows that not being able to get a divorce was also exceedingly financially ruinous as both spouses have claim to the marital assets. I'm not sure how no-fault divorce came to be, but IIRC it was also important for husbands when it happened, since they were "only" liable for alimony after a divorce, and not for arbitrary expenses.

No fault divorce allows the state to interfere with the life, living arrangements, assets and liberty of people who have not been convicted of anything. The normal protections people would receive in criminal proceedings are simply bypassed.

"No Fault" divorce does not remove fault, it simply assumes the husband is at fault and acts accordingly.

The UK does not have no fault divorce. And London is typically regarded as the "divorce capital of the world", because it is very one-sided in favour of women.

So no, there is no correlation between no-fault divorce and men getting screwed over.

Before no fault divorce you actually had to provide a legitimate reason to leave your marriage, thus making it harder to divorce and run away with your spouse's paycheck.

I don't think 'irreconcilable differences' is a high bar. Nor is 'alienation of affection', which need not actually be proven. As far as I know these were 2 of the common reasons why women would initiate a divorce before no-fault.

All divorce places men in the financial cross hairs of the state/courts.

The only time fault plays a part is if you have a very expensive lawyer who can use it as leverage and protect you using it.

I would imagine in the majority of cases it's almost impossible for a third party to know definitively whose fault the divorce really was. That's a pretty subjective thing in a lot of cases. Mostly hearsay..

The problem has less to do with no fault and more to do with the some of the bias towards women and the stay at.home parent. I mean some of.us actually wanted them to work, especially if they're sending them to preschool, but can't force them to.. you are basically stuck either divorcing them for staying home or paying up down the road
