The breakdown of justice in this country makes me want to scream. First we start circumventing justice with college kangaroo courts and MeToo. Now we decide someone who was wrongly found guilty and is innocent should be executed anyways? This is so FUBAR.

By allowing him to introduce evidence of his innocence, a federal court would be, in effect, rectifying the mistakes made not just by his lawyers, but by the state responsible for appointing them.

Therein lies the problem. The federal court system has no business telling the state how to manage its own shit. Dude exhausted his options for arguing ineffective counsel to the state, and now wants the feds to tell the state that they got it wrong. It doesn't work that way.

Either the supreme court would need to find that Arizona's legal framework is so egregiously unconstitutional that it must be changed, or the ball is in Arizona's court. Seems like the latter.

Once again, the supreme court isn't there to make decisions that feel good. It's there to determine constitutionality.

Ramirez, he described that the federal courts should only act as a review of state procedures, and whether or not they acted correctly when finding someone guilty. He said the court's lower rulings violated state sovereignty.

The us sc is to determine if the court system was legal, the laws were constitutional, searches were valid, etc not to determine guilt. It's not a court of criminal law.

Over-reaction. The argument is that evidence of innocence is not enough to get a Federal appeal, it should have been done in the state appellate system.

As others have pointed out the article itself is pretty bad and the core premise is flawed. The supreme court is just reiterating the way the system works, if you fail a state appeal you don't get to introduce new evidence to a federal court. One can debate the number of appeals defendants get and people try to change the process if they feel the system needs improving, but as far as I can tell (I admit I'm no legal expert) they're just making a reasonable ruling on how the law is written.

Much as that article seems well-intentioned, it begins by referring to the situation surrounding abortion law in the USA, taking the life-begins-at-conception position. I find this position impossible to support and the politicising of this man's plight with that unrelated claim is not very helpful.
