I don't know about the law in England. As a social worker, I would definitely recommend he receive some counseling. I would also wonder about home situation. Inappropriate sexual activity like this could be a sign of abuse or other problems at home. Not definitely, but possibly.

Legally, it's covered in the Sexual Offences Act 2003. http://www.legislation.gov.uk/ukpga/2003/42 Section 66 covers exposure and 13 covers children as offenders (but I don't think that includes offences under section 66). However, as a teacher you can and should recommend counselling or appropriate social work rather than pressing charges, especially if you think there may be other issues at play here.

To echo kersius and VanceBaryn I'm also not a lawyer. A 13 year old showing a teacher his or her genitals either doesn't know it's very inappropriate behavior or for some reason does not care that it's very inappropriate. Counseling should be strongly recommended. I would want that child removed from my classroom for weeks, if not permanently.

ofc this is assuming that it's not a legit coach/locker room or nurse situation. - it's not unheard of for a coach to have to step into a fistfight in the locker room, for example.

If the kid was in class when he did it with a group of other kids, it would unilkely be categorsied as anything sexual. It is more likely to be treated something like streaking at a footbal match.

My guess is temporay suspension if he admits it and nothing if he does not. Does he admit it? Did someone film it?

I'm not familiar with the laws in England. It is also hard to give much insight without a bit more detail surrounding the incident. It seems to me the appropriate response would be to find out why he did what he did and talk about more acceptable ways to get his point across. Very likely, though, he was just displaying rebellion as teenagers tend to do. However, the biggest worry would be that he is treated as a sex offender and potential rapist by feminist influenced culture which could psychologically damage him and even cause him to become those very things later! Without more evidence, it is certainly not clear to me that he needs to go into therapy but rather admonished for his inappropriate behavior and sent on his way. If he has a history of highly inappropriate behavior then maybe therapy is warranted to get to the bottom of why he acts out.

I doubt anything will happen in the UK. We do not really have therapists or counsellors in the Uk, I think it is an American thing. Authorities in the UK do not think it works. It will be recorded as horse play, (boys being boys) If he sya his penis was not erect aboslutely nothing will happen other than the school and police may be telling him not to do it again. If he did it again he will get a few warnings and then action may be taken. If it was erect it could be a sex crime of exhibitionism but again given his youg age I doubt anything will happen. Boys and girls at UK schools regularly expose themselves to each other, not usually teachers. We use to go into the girls changing rooms at school and they came into ours. Usually after swimming. I suspect the head will sort it out.

At 13 nothing will happen to the kid.

An old guy I know used to work as a teacher and tells how in his first year some of the girls started exposing their breasts to him. One of the them even stood up, turned round and exposed her buttocks. (I got pretty excited at this point but I like sex). After that some pupils started trying to climb out of the windows. He lost his job. Never made it to the second year. We all have a good laugh about this story now, men, women and girls alike. How ridiculous that our ineffectual friend could allow all this to happen. Reminiscent of St. Trinian's.

It is natural for young teenagers to experiment with expressions of their emerging sexuality. The question is whether you have been taking advantage of them or causing them to feel body shame.

The age of consent in England is 16. This child is 3 years away from being able to legally consent to sexual activity and cannot be construed to possess sexual agency.

What led up to this incident? How did you allow it to happen? Did you secretly enjoy it?

If you are struggling with class discipline or have issues around sexuality you may need counseling. If discipline is good, you did nothing to elicit this behaviour and obtained no pleasure from it, then your actions are pardonable.

He got his penis mistaken for the red apple. It's what happens when you forsake tried and tested traditions. Clearly he was trying to convey gratitude, but hadn't been taught how to. I can't help but blame you a little bit seeing as you're the teacher. I hope you're not an English teacher because one of your pupils commands language so poorly they reverted to very basic ways of expressing themselves instead of a rich and colorful language.

Think of the harm done to this kid. You looked at his erect penis and may have obtained pleasure from it. Did you leer at him? Did you take a picture of him? I certainly hope not. But for the rest of his life this child has to live with the thought of you enjoying or masturbating to a mental image of his erect penis. Kids that age simply cannot foresee the consequences of their actions.

In UK lessons there is always a teacher and a teaching assistant. Two adults. Where was the assistant? Also did you stop the lesoon or continue and complain to the head at the end? All of these things will influence what happens.
