yep. it looks like abandonment to a judge when you try for 50/50 custody of your kids. My lawyer advised me to stay in the home and that is the advice you will get from others who will comment and post articles about it on here. Unless you have physical evidence of serious abuse, don't leave.

He moved out before he filed because his wife made things uncomfortable at home. He let her know he wanted a divorce but she didn't. He would wake up to his (ex wife) standing over him while he slept down stairs on the couch. She never said anything just stood in silence and walked back upstairs shaking her head. In a no fault state the judge really could care less for your reasoning for wanting a divorce. If kids are involved they only want "what's best for the kids." In the end my brother got 50/50 custody and his ex wife stayed in the rental home. He wasn't penalized for leaving in fact it wasn't even brought up. Also, he didn't hire an attorney either. His ex wife spent over 20k (borrowed from her mom) on a lawyer and basically lost her case. She wanted him to only have the kids every other weekend. There's light at the end of the tunnel. Every situation is different and every judge is different. Best of luck to you and know that everyone deserves happiness!

Wanted to add: When he moved out he still spent time with his children and provided for them. (Take pictures of your time together and keep receipts of anything you buy for them clothes, shoes, food etc....)

pick a part of the house and make that your fortress.

pick a lawyer that will go to war if needed. ask someone who had a fair outcome who they used if you’re not sure who to hire.

also ask your lawyer what/how you’re allowed to record in your state

Its hard, I remember how terrible it was sticking it out in the same house. It was soul destroying.

However, it will depend on where you are, but for me leaving the house would have enabled her to claim abandonment, also since the kids were living there, it would have given her custody and then left me an uphill fight to get 50 / 50 restored.

Before you do anything, hire an attorney, and speak to them. I cannot stress this enough, find a good one and pay as much as you can. You will never regret spending money on sound, strong legal counsel. Believe me, years from now you will be glad you did.

First things first is get a lawyer before you do anything else.

They know the law and they know how your actions will affect your outcomes.

If you have made up your mind, then just file for the divorce. That is the hardest part. The rest will follow and imo, if you have a stable job and don't have a past history with courts, then you'll get 50-50.

As far as lawyering up and leaving house, every situation/court/judges are different, so there is no one rule that fits everyone. IMO, try to be as amiable as possible, because in the end, you have to deal with the kids mom for the rest of your life (College/kids marriage/grandkids), although it should strictly be business relationship at that point, but still, you have to deal with it.

She's acting shitty to get rid of you. Do the same thing back, start doing all the little things that annoy her. Leave dishes in the sink, socks on the floor. Be a shitty roommate on purpose. She can't attack you physically because you would destroy her, but she can attack you emotionally. Men don't play with emotions the way women do so we tend to be unprepared for their attacks. Want to really fuck with her? Buy furniture and start redecorating without consulting her.
