Here is the deal. The legal separation is great on paper. And a judge can take it into consideration when doing an eventual divorce. "All debts after the legal separation are awarded to the person that created those debts." But the deal is that each side has to sign that Legal Separation. If you ex refuses to sign? She can say, "Why would I sign this? I love spending money I don't have on sh1t I don't need."

Even if she does sign that legal separation? But the problem is that the credit-card companies are not a part of that agreement. Meaning, in the long run? They won't care. They'll want their money from the first pocket they can get it from. If the card doesn't get paid? They'll sue you. They'll get a judgement against you. And then it's up to you to take your ex to court to get repaid for her debts.

What to do? You need to grit your teeth and file for divorce.

In the mean time? Cancel your credit cards. Put a lock on your credit reports. You need to block any new lines of credit.

I know this from personal experience in my divorce. She didn't want to get divorced because she still wanted to remain on my health insurance plan for doctor shopping. She had her eyes on a new car, but she wasn't working.

I filed for divorce, and it was the best thing I did.

I think you’re looking for a formal date of separation. https://selfhelp.courts.ca.gov/divorce/date-separation#:~:text=The%20date%20of%20separation%20is,final%20break%20of%20your%20marriage. Find a similar thing for your state. From what I understand it’s just a conversation to declare your intent to separate and then your actions reinforce that. Not sure how well it would hold up, but if you want to document it, you could just write a doc and have both parties sign it for free.

Depending on which state you live in, you can file for divorce online and receive a financial restraint order the same day. My state even permits online digital signatures (for both parties) while filing. In theory you could inform your wife you are filing for a joint legal separation, sign for both and let her contest if she so wishes

Cancel any joint credit cards/HELOC, etc would be my first move.
