Yeah, it is torture. It is not easy when a child you care about is stuck with someone that does not take good care of them.

I doubt you have any good options. But, when she gets old enough, I think that the court has to take her wishes into consideration too.

It actually depends on where you live. Generally the family court system will not upend a child’s living situation unless there is a significant risk to that child.

Once a child reaches the age of 13 family court may consider the child’s wants also but generally not before. There are some states that are more progressive than others.

All I can really think of is document every time she says it. Build a solid case load and have your lawyer petition the court now. But this will cost alot of money.

The other option is I believe at 13 or 14 she can go to court and declare who she wants to live with. You will just need to provide proof you can provide her with a stable life as the sole custodial parent.

Either option is a long hard road though eith no guarantees

I am probably going to say a dumb thing. What if you offer your ex-wife more money? What if you tell her that you will provide her with more money if she is ready to do a 50:50 split? Would that be a dumb thing to say? I do not understand the laws in your country.Is not your child's mental health more important than money? Would social services change their position if your wife consent to it?
