As a rights-based subreddit, removing people's rights is not a solution I think we should entertain.

The solution is removing double-standards, improving due process, and protecting the accused person's rights.

No, disagree. Riding a motorbike is a risk, swimming in a lightning storm is a risk, skating on ice is a risk, but we're not going to jail people for engaging in risky behaviour. It's not illegal to leave yourself vulnerable.. stupid, maybe, but not illegal.

If you leave your car unattended while you pop into a store "for just a quick second though," and your car gets stolen.. yes, people will judge you for being stupid but it's still the car thief's fault.

I'd say it's totally valid if you want to shame the hell out of a woman who gets so disgusting drunk at a party that her legs fly open, though. And it's valid for men to walk away from drunk women because the risks of being called a rapist are just too severe.

I also love how this doesn't apply to men. Even worse, I've woken up to women riding me after I blacked out and it was either a joke or just not a big deal to them. THEY DO NOT CARE. Most of their anger is performative. A lot of the shit they cry about, they're not actually that pissed about, they just can't help themslves any time there's a chance to play the victim or pat themselves on the back.

Oh it's worse than that, there is no LEGAL standard for too drunk to consent, obviously a passed out woman can't, but how many drinks is too many? Moreover MEN are NEVER given the benefit of this, that is a guys alcohol consumption is never considered, either in terms of a mitigating factor, or making them the victim.

It’s funny because if you hit someone while driving drunk, you being intoxicated doesn’t excuse the fact that you did something dangerous, so why should it be any different with consensual sex.

Also what if the genders are swapped is it grape for a sober woman to have sex with a drunk man?

I wouldn't say it should be illegal for a person to drink, just on the offchance that they might get raped.

What I would say is, if two people are both equally drunk and they have sex, then the rape accusation should go both ways.

Now I've always said don't cover yourself with honey and walk into a bear den. It's one of the main reasons I absolutely refuse to ever drink with men or hang out with men alone. If I want to drink and have fun I should be able to without worrying about some psychopath raping me. If both people are both intoxicated i wouldnt label that as rape. However if your ass is sober and another person is black out drunk yes absolutely without a doubt that is raoe anyone with common sense knows that. This whole post basically makes it seem as if men have no awareness or control over their sexual desires and just have to jump on someone who is clearly defenseless. The first issue of consent is not whether the woman is drunk, but whether she is too drunk to consent. There should be a very strict explicit legal standard at which this can be established beyond reasonable doubt. It must be clear that the woman could not reasonably offer consent and that the man could not reasonably believe she was consenting. Being falling over drunk is not a sufficient condition to render her incapable of being willing and knowingly consenting. Many people in such a state enthusiastically engage in sex.

A second issue is that if both parties are engaged in sex while drunk, it is not reasonable to presume that only the woman may be too drunk to consent. It may be the other way round. And additionally mens rea is required to establish the assaulter is also conscious that the other person is not consenting. Being drunk may well remove such awareness. Under the law this is typically not a defence, but perhaps it should have as much weight as the degree at which inability to consent may be assumed.

A third issue is gender parity. The law should apply equally to unwanted sex by a woman on a man, with the same consequences for the perpetrator. Made to penetrate should have the same legal status as unwanted penetrative.
