counting a penis nonconsensually enveloped by a mouth, vagina, or anus as a form of rape in rape statistics
attempts to make rape laws gender neutral

There is no patriarchy. We live in a society where a maternal grandmother has more parental rights than a biological father, and and all parenting decisions begin with a “woman’s right to choose”. Federal laws proclaim “she must be believed” which inherently implies “he must not”…. There is no patriarchy and no argument can realistically be made to support it. Women took control of society and 20m fatherless homes is the proof

Feminists truly believe that men will advantage other men at the expense of women. That is one of their fundamental premise.

Of course, the legal reality is that there is a critical shortage of laws and policies that advantage men at the expense of women and a massive surplus of laws and policies that advantage women at the expense of men.

Now, feminists find themselves in a conundrum here, when there is an actually written in black ink on white paper standard that explicitly advantages women and disadvantages men which is the exact opposite of what they believe.

Now, what will feminists do? (Tense "Who Wants To Be A Millionaire" music starts.)

A) Deny the legal standard that anyone with access to texts of laws (i.e. anyone with an Internet connection) can read if they were so inclined.

B) Accept that their fundamental premise is now very questionable.

C) Ignore anyone pointing out to the legal standards that cast doubt on their premise.

D) Desperately try to spin an obvious female privilege under the law as somehow a male privilege, by simply stating it and refusing to elaborate further?

People are just saying "Patriarchy isn't real" but I feel like that doesn't explain things very well

So, first we have to look at the actual facts here. The reality is that rape laws are often gendered, either explicitly (Ie, if Rape is defined as when a man forces a woman to have sex against her will, that cannot by definition be done to a man) or implicitly (Ie, if rape is defined as forced penetration, a woman can still do that, but is far more likely to rape in other ways.)

Then, the rest of what you are describing is an idea of why rape laws are that way, utilizing patriarchy theory. To understand what that means, you must understand that the concept of patriarchy is a sociological theory used in feminism; it presents the idea that society has been historically set up for the benefit of men at the expense of women.

Thus: The explanation used in feminist patriarchy theory for why rape laws seem to exclude men is that this is actually because women are devalued and seen as weaker, and is not an example of the institutional oppression of men.

Now, bear in mind that is not the ONLY theory there is. That is just a widely popular theory used in a lot of feminist academia.

Other explanations might be more that rape was originally defined this way due to the history of how it emerged as a concept; originally meaning "To Despoil" before eventually evolving into a sexual act forced upon a person. From this perspective, rape laws are gendered because the concept of rape evolved over time and was at one point simply largely defined as a thing done to women.

Another may be the concept of male disposability - that men are expected to shoulder burdens for broader society, often up to their lives, while women are seen as important by their existence and must be protected. Similar is the Empathy Gap, the idea that men are simply seen as less valuable on an individual basis and less worthy of concern. These are the theories common among MRAs, are this is often paired with a larger idea that each gender has their own issues and expectations - women must be protected, men must be disposable, etc, and that this restricts people. And thus this disparity of rape laws is the result of the expectations placed upon each gender, not the exclusive fault of one or the other.

Others point to a biological aspect - rape was seen as a crime done to women because women can get pregnant, and thus undermined the choice of a partner and whatever historical partnerships are involved in that. Thus, the context of the rape of a women is different, and this is probably why rape laws are historically gendered. It's a biological explanation, as such.

The point is, there are many other explanations. What you should get out of all that is essentially...

- The gendered aspect of rape laws is an observable reality

- The explanation for it varies and there is not really a 'correct' answer

- What you have encountered is a feminist explanation for this, rooted in patriarchy theory

Now! I know that's all a little complicated. But hopefully you can understand.

Gender neutral laws aren't a thing, because the people pushing them forward do not really care about gender neutral laws, or they would make gender neutral laws.

There is an epidemic of female teachers raping male students but they dont seem to want to count those. Plus I dont see how feminists can talk about something like patriarchy that they have never had the pleasure of experiencing

If that were truly the case they wouldn't be stopping any change to the laws to make them more inclusive. Thanks to feminist women and their simps, men in a lot of places cannot legally be "raped."

The way I see it, patriarchy and men are separate things. Patriarchy is a system, admittedly set up by men but the relevance of the structure doesn’t really serve men in todays world anyway. I’d like to see acknowledgment of the patriarchy as a separate discussion from men. I think if we all recognise that patriarchy only serves a select group and enforces negative restrictions on everyone else the discussion might feel less loaded.

I wasn't sure about the patriarchy part, so i thought this would right place to ask this question. You can read and give your opinion if you'd like . I personally don't agree with your assessment about patriarchy responsible for this mess.
