Did you have an affair? The friend could file a civil suit for harassment in most states depending on what is asked for via the supeona... Even if you did fuck her there is not much that they can do about it, and even fewer judges that are going to care about it...

Yes, we had to depo everyone in my case all that came about from it was about 100k worth of legal fees, sometimes you just have to roll with the punches. while the STBX burns through the cash.

Your wife's attorney is just looking for a way to bill more hours - a bill that she will ultimately expect you to pay.

Infidelity is no longer a crime and even in states it is a crime, it never gets prosecuted. Only stupid people try to prosecute it

It’s an intimidation factor and a money grab by the lawyer. At least in my southern state it is. Nobody cares about affairs. They are only concerned about the children involved.

Get a good divorce attorney and be ready to see a bunch of garbage come across from her side.

My ex was cheating and moved her affair partner in 10 days after we separated and nobody could have cared less that she moved a married man in with my 1 and 5 year old girls.

But, from my experience, if she is subpoenaing people, then she is going to try to scare you into settling at your expense.

And except as the poster above states (separation date, reimbursement of squandered marital assets) - an affair is not relevant.

And yeah, be honest, you were cheating. In reality- no one cares.

Actually, unfortunately, your friend also needs an attorney. A subpoena is not a voluntary document, you cannot ghost it (without consequences for your friend). An you need to be REAL careful in this situation. You helping your friend craft a response, who is now a potential witness, can be legally problematic.

To your question, yes it "can" be done. But most places the law changes were adultery is more or less off limits (unless somehow there is an impact to the kids) EXCEPT for one question, spousal support. If there is a chance either could get spousal support, usually a cohabitating relationship ends that obligation.

In theory, they could argue they are trying to establish a date of the breakdown of the marital relationship (which rarely matters) for the purposes of looking for squandering marital assets (i.e. if you are having an affair, spending lavishly on your AP can be credited against your share of the marital estate).

What this means is they could, in theory, have a superficial relevant reason to ask but they also have to have a real reason to believe it's true (they can't subpoena every woman in town to ask if you've dicked them down or not).

The question is what's the subpoena? Is it for records? To a deposition?

Your attorney can fight the subpoena. Why would the alleged affair even be relevant if true? These days it rarely matters.

If your wife starts hurling baseless accusations of cheating, she is very likely the one cheating.

Just remember, everyt ime you meet with this friend, you may be giving your wife ammunition. If you must meet with her, take a 3rd party witness.
