File for divorce and stay in the house until you can get agreement on who pays what if you move out. You are in a weak position because the courts will keep status quo on who pays what while divorce is pending unless you can prove her income. So if you file and move out you will potentially be paying for your apartment and the house. So stay in the house. Play nice and sSTOP arguing about expenses because you will find out lawyer fees add up fast and will make your monthly house expenses seem inconsequential in comparison. Stop arguing about anything it won’t change anything now. So stop arguing and file for divorce, stay in the house and don’t give her a reason to have you thrown out via restraining order.

Staying keeps your leverage, but don't wreck your credit out of spite. Line up a new place, document everything, and push for legal action ASAP. She won't change until you stop playing bill payer in chief. Time to show you mean business.

It would help to know what state you're in and other details, but I'm imagining that half the house, half the financial assets and half of her business are yours.

So - any damage you to do her is damage you do to yourself.

No matter how desperate your personal circumstances may be and no matter how bleak your future may appear you *NEVER* help yourself by improperly managing your finances. The person you will be hurting is future you, and that guy is going wonder what he did to deserve this treatment from you.

I sent you a DM with an overview of the divorce process. As you stated it, it can take anywhere from 6 months to 2 years to get everything done. So you might as well file sooner rather than later.

The advice about not leaving the home has to do. If there are children in the house. It sometimes can be seen as abandonment. As the kids are no longer a factor, it's less important. What can happen is if the house needs to be sold, and she's in the house and you're not, she will try to drag her feet on the home sale. That's what happened with me .

In my case, no children, together for 17 years, married for 12 years. I left and she stayed in the house. That was the best choice in my situation, because it would have been insanity to stay on the house with her during the divorce process or separation. She did drag her feet on the home sale which results in us losing a ton of potential money.

I didn't want the home, she couldn't afford the home, and neither one of us were willing to walk away from the equity; so the house had to be sold.

My advice is in the DM I sent you, but in brief add up all known communal assets and debts. Divide by two, and that's what you each are going to end up with. Talk to a local attorney to see if it's likely that she will get spousal support. If so, figure out what a fair and legal amount would be( that doesn't mean what you think is fair. I mean fair in the eyes of the law).

Go to mediation and try to hammer out a mostly fair deal to just get it done.
