Hire an attorney. Pay the retainer. 15K is probably a fraction of what you’ll lose in home equity, credit damage, etc. you’re going to need an attorney to get this done anyway. Might as well do it now instead of waiting for months of additional financial damage to be done. Your attorney can be given a retainer with marital assets. Then, close any credit cards or accounts she has access to. These will “motivate” the process.

I thought I explained already that not divorced by stating am looking for affordable counsel. That is the obviously what I am seeking to sell but cannot if both names are on the mortgage. Additionally, from research of family court matters in my county divorce ce proceedings are backed up to about 17-20 months.
What to do in meantime with bills and mortgage? The very notion is irking the fuck out of me. It’s like having a non paying tenant occupying a your rental unit.

If you don’t care about the equity in the house, default and walk. You can go the judicial route, but even if you get a judgement that she owes you more than what is her equity share, good luck collecting on that, she’ll just declare bankruptcy. Run the numbers, and see how you come out ahead.

I am in this position. I went the judicial route, forced sale. All that time I was paying for EVERYTHING, even though I was not in the house, but had full custody of the kids. Now, what she owes me, exceeds her share of the equity. If I had to redo, I would have foreclosed, and saved myself all the legal fees.

Dude, sell the fucking house. Let’s assume your wife refuses. Fine. Force a judicial sale. The sale will be ordered and the mortgage retired when it sells.

That’s the other thing. When I try talking to her and tell we need to move out or we need to sell the house, take a wild guess and what that answer is.

I’m in the same boat and pay for everything, lawyer just said keep paying and document it. She will have her day of reckoning in court.

I asked her by WhatsApp and asked her lawyer by letter for her to contribute. They wrote back saying my request was intimidating.

Spending $15k (more precisely, a retainer) to force a sale/partition is far better than letting it foreclose.
