I was very rushed when I signed my lease agreement on my new apartment. The leasing company told me that the apartment was being shown to multiple other potential tenants and that I'd need to sign the lease quick to lock it up. In retrospect, I'd like the lease agreement thrown out....I was obviously coerced!

Any good divorce lawyer can shred a pre nup.

There are 100 diffrent paths they can take they will find one that sticks

Prenups are not as vulnerable as some people believe. It's confirmation bias: you only ever hear about the ones that are challenged or the ones that fail.

Also keep in mind that she's only challenging the prenup, it hasn't been voided by a court. One might choose to challenge a prenup even if you have very little ground to stand on legally, because it gives you leverage in negotiations. "Give me an extra couple percent and I'll drop the issue." When you're talking about billions of dollars of assets, challenging the prenup is almost always the correct move: even a small concession will easily cover the cost of a lawyer.

That said, the lawyer could have, and should have, done a better job. Having her sign the prenup so close in time to the marriage is obviously a bad idea, any lawyer should know that. http://www.kohtzlaw.com/prenuptial-agreement.html

I'm sure somebody will mention that the woman can simply lie her way out of everything. This is simply untrue as long as the lawyer does his job right and everything is documented. If it's your word against hers, and you have video evidence while she has nothing, you'll win no matter how "biased" you think the justice system is.

I think it means that if the wife is rich enough to support herself after divorce, and she waived right to claim alimony when singing prenup, then he would be clear.

I think the only things that can't not be negotiated in prenup is child custody and child support.

There's a good chance of that, yes, although it will probably vary tremendously by state.

Prenups aren't meant to leave the woman with nothing. They're simply there to give you a better deal than you would have gotten from going through a divorce without one.

It sounds like they are helpful if you are wealthy but not complete firewalls. And it never gets you out of basically being her social security option. Which is a big problem for guys who dont have much money to start with and who are also more likely to marry women who will need social security. Especially in this economy.

This suggests to me the optimal route for most men (optimal is not really the word, since they did choose to get married, but anyway) is to include in the prenup that she will get a 3-6 spousal support in the event that she is unemployed, and after that reasonable time period for her to find a job, the spousal support ends. Include a clause that gives her a decent stipend for living / income for a short time period and then cuts off. I have no idea if that actually works out more in practice, but it seems like putting the onus on her to bring the suit back up after 3-6 months to elongate the spousal support and prove she cannot find employment is much harder for her.

We need to get some lawyers up in here who have experience winning divorce cases (winning as in, relative to what men can expect in this shithole).

It is for the same reason why over 90% of criminal cases end with the accused plea bargianing and pleadig guilty, even they are innocent.

That is why when talking to cops, you are always firm but polite. Otherwise that pencil you are holding in your hand might turn into assualt with a deadly weapon. When he was putting the cuffs on you, and your face slammed in the ground, and he put his boot on the back of your neck. That all of a sudden is resisting arrest. While you where in the cuffs, you mouthing him off and calling a pig, why you where attempting to escape. Unfortunate why you decided to do this ontop of a set of stairs.

Ofcourse if you have enough money and a good lawyer you can fight all of the above allegations, and probably win compensation for police brutality. Most lawyers like cops are not your friends, they don't want to go up against the system.

That is an excellent video. By firm but polite do what it says in the video and don't mouth off cops. A cop if you piss him off can find any reason to bust you for something. But usually they go after easier meat.

There are not 100's of different paths to violate one, there are only a couple that are often forgotten.

1: Prenups can never determine child support or child custody, anything pertaining to children, current or future, will be grounds to get it tossed out.

2: Prenups require both parties be adequately informed. This has been determined to mean that each party needs separate legal advice from their own lawyer. You can't use one lawyer, that you paid for, to provide advice for both of you as she can claim the lawyer misled her. She needs her own separate legal counsel that she pays for. This also means you need to fully disclose your financial assets to her prior to her signing the prenup, if you hide some or don't tell her about your true worth then she can claim she was misled and get it violated.

3: Both parties need adequate time to consider the legal ramifications prior to signing the document. This doesn't mean time between signing and the marriage but time between seeking legal counsel and signing, so her claim in the article won't mean shit in court.

4: The agreement can not leave one party destitute, though this is often not seriously applied to the male unfortunately.

So basically you need to seek legal counsel and have it drafted, then present it to her and then she needs to seek legal counsel. If she refuse's to seek legal counsel then you refuse to marry her plain and simple. After her seeking legal counsel, you both plan a time for both of you and your lawyers to meet up and discuss the document. You'll both negotiate over it, don't get emotional and eventually an agreement will be had. You both sign it with the lawyers being witness. Then you can go see the judge for the marriage license.

It's not cheap but will save a ton of cash in the case of eventual divorce, and it'll even prolong the marriage as it removes the incentive for her to jump ship.

And in all cases, seek legal counsel of a lawyer with a solid reputation for making prenups that have held up to challenges in court. They will best be able to advice you for your particular state, country and legal situation.

Dude you'd be amazed when you see what people throw together. The worst is that people often "value shop" for stuff like this and will get a paralegal or a newly licensed attorney to throw one together. Then go home and get fiance to sign it, and somehow think it'll hold water in court. You don't actually need a lawyer to create a contract, but without one the chances of you doing it right are nonexistent.

The problem is also that lawyers know how to get clients. If I claim that for a higher price, I'll be able to help you draft a prenup that keeps 70% of your wealth post-divorce, you won't choose me. If I say for a lower price I'll draft you up a contract that will let you keep 95% of your wealth, you'll think "of course, why the hell would I pay the other guy."

One would hope that his lawyers were well-paid and competent enough to avoid all of this.

They aren't useless. They're very useful and if done right are routinely enforced. Prenups that break every rule of prenup are worthless -- like ones you drop the week before the ceremony.
