I met a man yesterday that roughly had the same issue - Except enforcement told him (laid off, not working) because he had his CDL (Class 1) he had the POTENTIAL to make 14-16k / month so they told him at that rate it would be 86.4% of his pre-tax salary (what his ex and her lawyer had decided) to pay for the kids, mortgage, car payment, insurance, utilities, food etc..

Keep in mind he was not working, but he had the potential to earn this much (they just pulled this number out of their ass because as a trucker that's not a possible number - especially since you'd be in the 54% bracket for taxes here)

Unable to pay rent he did land a job driving truck, but since he couldn't afford any place to live his new boss let him sleep in the sleeper cab in the yard when he was in town.

She kept the house, he lost access to his kids.

His crime? working away from home to pay for an expensive wife and 3 kids - She dissolved the marriage and filed for divorce because he was ' away too much '.

I've posted this before, but I basically waived getting child support just to ensure the custodial agreement isn't re-negotiated. It is still a risk but a type of insurance I do not mind paying for.

Of course we all know income based pay distribution has nothing to do with the cost of raising a child, and in my case I can afford to miss her contribution.

I might be in a similar situation with the kids. It's costs me about $400 a month to feed / cloth /entertain them and I have to pay over $1000 to her. If it were reversed, she'd pay only $200.

I've been behind, at the most, 3 months in the past, usually when I got laid off or something... without fail, when I would get over a month behind the Child Support office would seize my entire bank account. I had my current wife at the grocery store, buying food for our family, including the kids, when suddenly the bank card didn't work. It's crazy... THEN, when I had sole custody for a full year, they didn't even order my ex to pay anything. But when they moved back to her house they tried to make me pay support for the previous year, when I HAD the kids. The system is so screwed if you're a male.

I don't understand? From my understanding, child support is based on income, isn't it? My buddy pays $300 a week, but this upcoming week, we're off for unpaid holiday leave. he says he must still pay the $300 or he'll be arraigned to court.

if the woman doesn't have a job, then maybe $50 is a lot for her. (of course, people do game the system by working under the table) but, it is a strange circumstance. custody law is fascinating in this era. I would really like to know what laws are being drafted for custody of cryogenically frozen fetuses, for example. it's sad that such a large number of couples are faced with figuring out custody. I wish it were as easy as finding a great human being to spend the rest of your life with.
