Does it matter who files first?

I’ve also wondered this and it seems (as others have said) that legally speaking, the answer is no.

In my case, my stbx has been poisoning my reputation with her family and friends for years, telling them how abusive and controlling I am and making herself out to be the victim of some horrific monster.

The truth is that she is abusing her prescription meds and is a shit mother and wife who can’t hold onto a job and needs someone else to blame for her failures.

So, for me at least, filing first would at least be a PR victory, even if that’s really not a mature or productive way to approach things.

It matters from a strategic perspective. Taking the offensive is usually beneficial but there can also be some advantage in seeing what they will claim before you file your counterclaim. Sometimes the other side will freak out if you surprise them which can make things worse. Sometimes they'll file first and come at you with a TRO or some shit like that. Filing first gets your story out there first. Filing first lets you control the calendar in the beginning. Filing first puts them on the defensive and they are reacting to you, which is better than the other way around. Lots of possibilities depending on your situation.

No. Courts have ruled that it will not affect any outcome if 1 person is the petitioner vs the respondent.
