You may be surprised to learn it would not have been a crime for him to have sex with the girl, but it was a crime to send her nude photos.

Officials with the Iowa Attorney General's Office, which is not involved in the case, explained that under Iowa law if a potential victim is 16 or older, there's no possible abuse charge under the code section as it is written now.

Beth Barnhill with the Iowa Coalition Against Sexual Assault said Iowa law needs keep up with technology.

"If you're 14 or 15 years old, it's illegal for someone four or more years older to have sex with you even if you consent. However, one you become 16 not of that applies," said Barnhill.

While 16 is the age of consent, it is a crime to text nude photos to anyone age 18 or under, which officials said is an inconsistency in the law.

A man is facing charges of dissemination of obscene material to a minor after a citizen reported a suspicious conversation between an adult male and a teen girl at a McDonald’s.

Officers found 29-year-old Jonathan Lee Yates, of Virginia, in a vehicle with a 16-year-old girl at the 401 South Ankeny Boulevard location around 5:45 p.m. Tuesday.

KCCI got a chance to speak with Yates after he bonded out of the Polk County Jail. He told KCCI’s Laura Nichols that he doesn’t think he did anything wrong.

Yates said he sent a few photos to the girl “two or three maybe.”

He said he met the girl online five months ago on a site called Chat Hour and drove 15 hours from Virginia to Iowa to meet her in person for the first time Tuesday. Yates told KCCI he knew the girl was 16 before he sent the photos and drove to meet her.

“I love this girl tremendously. She loves me,” Yates told KCCI. “We are planning to be together when she turns 18 years of age.”

Yates said he doesn’t consider himself a pervert.

Yates said there is a no contact order against him. He also said he still doesn't think what he did is wrong.

“So do you think what you did is a crime?” Nichols asked.

“In my opinion, no,” Yates said. "I just think it's messed up how you can get in trouble over sending a picture."

I think that we should have equality. However, as someone who did not have parents in his early teens, my relationship with a woman in her mid 30s was very healthy for me. I am not familiar with the literature on this type of thing, but I am 38 now and am very grateful for that relationship. I don't have the answer, but I am confident it requires way more complexity than comparing peoples ages.
