In Spain, you don't go to prison with a sentence of 6/7 months. You stay in probation and/or get a judicial fee, and you're free during the sentence time, unless you commit another crime. Judges only send people to prison above 2 years and 1 day sentences.

By the way, our Ley Integral Contra la Violencia de Género (Law Against Gender Violence) is an absolute disaster. If a woman acusses a man of gender violence, he is process using this law, and his life is destroyed, because he is, almost, guilty, until he proves that he is innocent. But, if a man acusses a woman, a man acusses another man (gays), or a woman acusses another woman (lesbians) the law doesn't apply, and they face the Penal Code, that it's more fair to both parts.

Now, after years of abuses, the Law achieved that when a woman acusses her partner of gender violence, neither the police or the judges believes she. This case is a perfect example, because 3, 2 years ago, was unthinkable that a judge acusses both members of a couple that had have a fight.

Perhaps I can lead you to water with an analogy. What if, just for instance, someone made a poison that did not harm you directly. Suppose it is some compound that simply shaves off the telomeres, attacking them directly, leading to advanced aging.

What if I introduce it into your food in such an amount that it costs you 5 years of life. You don't even notice. No pain, no symptoms, nothing to tell you that you had been poisoned and your life had been shortened.

Would you think this is not violence because you are not experiencing direct, immediate harm?

Violence isn't just pain. I can slap you, and it is violence, but how much have you lost of your life? Barely anything. On the other hand, to lock you in a room you cant escape and disrupt/destroy your 'free life', forcing you to have to rebuild it and with the penalties of being an ex-convict (lack of job hiring), would not be violence? Even though I deprived you of far more than what I deprived you of by a mere slap of the face? You judge that physical assault as more violent than time spent locked in some place you can't escape, and the destruction to your life that it causes?

If it were me, I'd accept corporal punishment; 50 lashes compared to being locked away for months or years.

You do not go to prison in the USA for defending yourself even if you smash someone's head in if warranted. It is based on the principle that the person initiating the illegal act carries the responsibility for all and any outcomes, hence why, e.g., a perpetrator can be charged with the death of innocent bystanders shot by police or anyone killed by accident caused related to the commission of a crime.

I admit that situation seems pretty shitty.

I still don't see it being the norm though.

For example here in the Netherlands, a few years back the police blocked of a highway to stop someone who did not pay at the gas station.

This caused a traffic jam which included car's from ordinary civilians, the thief drove straight in the back of a car killing innocent civilians.

So is this the fault of the thief or does the police also have responsibility in this situation?

Yes the thief stole gas, and evaded police, that is bad.

But is it worth it to catch a gas thief using such drastic measures?

There were other options, to follow this person, so in this case I would think suspension is in order, even if they didn't do anything wrong directly, they should reevaluate their priorities, yes you want to catch the bad guy, but the broader picture is more important.

What I am trying to say is that these things can be very complicated and are not always cut and dry.
