I find it utterly hilarious that the reporter sounded so surprised by the idea of them wearing "only a speedo" and "a bikini" when they were taken away. It's a beach.

But more to the topic. The sex offender registry has become a joke. Malicious intent should be a primary factor for being put on this list. Not to mention that kids walk in on their parents having sex all the time. By this court's logic just about every parent should be on a list.

We should try to get that organized. If parents have sex with the children catching them, they get put on the registry.

Obviously witnessing sex is a traumatic thing, and everyone should be punished if they do that to children in their own home.

They weren't just suddenly overcome by lust and couldn't make it to a private place in time. It's no different than masturbating on the train or exposing yourself to nuns to get your jollies.

That is the spin and disregarding the facts of the case. The guy had a prior felony conviction for trafficking cocaine. The woman was a first offender. They were both convicted of the EXACT same crime two counts of lewd and lascivious behavior. They are both required to register as sex offenders.

You need to understand the law before you make assumptions that this is a double standard. He is a prison release reoffender, he committed this offense within three years of being released from prison. The Florida statute requires him to get the maximum sentence.

To call this a pussy pass or a double standard is idiotic and based on your feelings rather than the FACTS!

in the video it said the max penalty for lewd conduct in public is 15 years and the guy got 2. although i think community service in the case is best for both of them

3. If the state attorney determines that a defendant is a prison releasee reoffender as defined in subparagraph 1., the state attorney may seek to have the court sentence the defendant as a prison releasee reoffender. Upon proof from the state attorney that establishes by a preponderance of the evidence that a defendant is a prison releasee reoffender as defined in this section, such defendant is not eligible for sentencing under the sentencing guidelines and must be sentenced as follows: a. For a felony punishable by life, by a term of imprisonment for life; b. For a felony of the first degree, by a term of imprisonment of 30 years; c. For a felony of the second degree, by a term of imprisonment of 15 years; and d. For a felony of the third degree, by a term of imprisonment of 5 years. (b) A person sentenced under paragraph (a) shall be released only by expiration of sentence and shall not be eligible for parole, control release, or any form of early release. Any person sentenced under paragraph (a) must serve 100 percent of the court-imposed sentence.

The guy only got 2 years because the DA cut him some slack and withdrew the prison release replete offender status. (All of which has nothing to do with the female) Had he not done this the guy would have had to serve the entire 15 years. As it is the judge sentenced both of them to the terms of the original plea deal.

Men are more likely to have convictions. A man and a woman could commit a lifetime of the same crimes and the man's could snowball and the woman's could never result in a conviction.

I'm not saying that happened here, but this line of posts suggested it.

They both should have been punished. Neither should have gotten prison or a sex offender registration, that's stupid. What, you're going to be worried about protecting your kids from the person next door who had sex on a beach once?

This is one crime where a slap on the wrist is deserved.

What's sad is that the punishment she got for having sex with a consenting adult in front of a child is roughly equivalent to the punishment she would have gotten had she actually had sex with a child. That's pretty sad.

But they imparted "Carnal Knowledge" on children. That is the definition of criminal because it "defiles" their minds. Kids who saw that are now much more likely to try it sooner in life, which is going to pervert their brains.

I know you're being sarcastic but I do think it should be criminal. Maybe 10 days in jail to let them know what they did was wrong and probation is acceptable I think, though.

Unless they were doing it specifically because they got excited by kids watching, in which case a sex offender registration and prison time makes sense.

No, but intent does change the danger they pose to children in the future. The sex offender list is designed to let people know if someone is around they need to protect their children from.

Chances are, if these people were just trying to have romantic sex on the beach and this was all a horrible accident, they will never do anything like it again, and parents don't really need to worry about their kids around them.

If they deliberately sought out children to have sex in front of, they are likely to try and do this again and parents should be aware of this so they can keep their children safe.

I think the only real problem with it is that the list itself holds certain connotations with it.

At least that's my only real issue, but I mean... what's there to do about that? I don't know. We need to fix up the list for a multitude of reasons.

If you're on it, people are probably going to think you molest children first. I doubt they will even think "had sex on a beach", or "peed in an alley".
