The fact that you don't all get that the crime you are describing is defamation and are instead calling for worse punishments shows how willing you are to disregard the law. I am ashamed of this subreddit because of the responses to this post.

To the small amount of you saying I'm a feminist, you're morons. Plain and simple. One check of my comment history would show you how wrong you are, but you don't care about research because you're just as bad as feminists.

Seriously, you guys may not want to hear this, but your emotional lynch mob desire for a perverse application of justice is no different than their own actions. I understand the outrage, I know how much some people are hurt by these accusations. I know how the law has refused to prosecute these liars in the past. But that does not justify an overzealous punishment in the present. The law does not work that way and SHOULD NOT work that way.

The boy who cried wolf ended up helping the real wolves to get away - false accusers do the same thing. It's a pretty terrible thing to be helping rapists whilst deliberately trying to get an innocent person's life completely ruined. A successful false accusation of rape does as much damage to someone as an raping someone, maybe more, and so should be treated very seriously because it nearly could have destroyed some innocent person - not to mention help actual rapists' defence.

I'm not debating anything. There is no debate. Punishing a person who accuses someone of rape as if they raped a person should not be. Just like any other crime, there is attempted murder, attempted arson, purgery, etc. These all have lesser punishments. This is at worst defamation or libel (not sure which) and therefore should be punished based on how intentionally they defamed/libeled the person.

So there is no debate. The person calling for her to be punished as if she raped someone is wrong. They are no better than the feminists claiming we should just believe women. And their extremist defensive stance is NEVER going to fix anything.

okay, you're not following so I have to spell it out for you.

I have not stated that anyone has said that she should be eaten or killed. The only time I've said such a thing was in a METAPHOR or HYPERBOLE.

The METAPHOR being, the boy being eaten is the equivalent of the woman being punished the way a rapist would be punished. Hence all of the mention of eye for an eye punishment

Yes, because despite not being in support of this woman's actions I am not in support of lynch mobs. I support a rational reasonable punishment for all people.

The facts of the matter are this, just because you see an inequity in the law does not mean you should push to punish the people using that inequity just as inequitably as some sort of retribution. You should push to have the inequity fixed.

Laws that are punished based on how it makes you feel are not justice.

Laws need to provide some sort of deterrence against breaking them. The more serious the offence, the more serious the deterrence. Would you support handing out community service to someone who repeatedly beat a woman? Would you support it for a serial murderer? I don't think you understand the magnitude of the crime of a false accusation; she literally tried to destroy his life. Stop seeing only the woman in this.

I'd agree, I think rehabilitation and education is typically more beneficial than throwing someone in jail. My argument said nothing to the contrary. I merely asserted that it is truly unfair to treat men differently than women for the same crime (ie. If a man would be punished with prison time, so should a woman.) Where exactly does an eye for an eye come in?

A false accusation amounts to the use of the police as a proxy for violence against the victim. Perpetrators should therefore be held accountable for everything the police do to the victim in reliance of the lie. False imprisonment, assault and battery, kidnapping and perjury should be standard charges brought in cases like this. I see no difference between me hiring a gang of goons to do this to someone, and a woman lying to the police to make them do the same. I also feel conviction should earn a place on the sex offenders registry. It's a sex crime, and the registry is designed to protect the public from predatory people.

I think that if someone is going to lie and accuse a person of a crime that would get them put into jail for years that the punishment should fit what they almost inflicted on another person.

No, you don't just get a warning for attempting to set someone's house on fire, you get charged with attempted arson.

She did get made an example of. She got punished for her offense. In fact, when she was shown the footage she realized her recollection didn't match what happened and confessed that she had been wrong which probably contributed to the lighter sentence.

Also, she is going to be supervised for the next 3 years. Idk what that means in UK law but in the US having to meet with probation officers is a pretty big pain. Also the article doesn't mention the number of service hours, but anything above 50 is quite a pain in the ass.

I think that is a pretty decent deterrent and frankly your asking to lynch someone as an example like it's a rational thing. Which is pretty fucking disgusting. You're no better than a feminist.

No, but you should get your head examined and consider sterilization if you're going to teach your kids one day that so long as they don't succeed in doing something bad that they tried to get away with it that they should only receive a time out for 15 minutes instead of being grounded for a week.

I'm of mixed feelings about this, quite frankly. On the one hand, I'm wary of setting up laws that discourage rape victims to come forward, and I definitely think false allegations should at most only warrant charges if it can be proved that the claimant lied. On the other, rape allegations carry particularly bad social consequences for the accused, and I don't really feel like community service is a just punishment for trying to get an innocent person convicted of a crime they didn't commit (any crime, not just rape). I certainly don't think imprisoning false accusers for the same amount of time their accused might have received is fair, but some time in prison seems appropriate.

As I said, I'm torn, but ultimately I don't feel this woman's sentence was harsh enough. She should do time—maybe 6-12 months—and suffer all the social consequences of being convicted of a felony. I take rape very seriously as a crime, and as such, false accusations get my blood boiling as well. I do feel this punishment was a slap on the wrist and that there should be greater consequences for such callous behavior. Not years of imprisonment, but time nonetheless.

Crimes should not be punished based on feelings.

We don't know how many community service hours she got. It could be 10 it could be 300. 300 is a LOT of time. It's a pretty severe punishment. So since you don't know, you can't say she got a slap on the wrist. I also don't know what being supervised for 3 years means, but I imagine there are also downsides to that. Maybe she can't travel without permission.

So we come to the question, do you want the punishment for a false rape accusation to be a deterrent, or a lynching?

Making it a felony, and giving jail time makes it a lynching. A felony means you become incredibly disadvantaged when applying for jobs. This is beyond a deterrent. This is much closer to eye for a hypothetical eye punishment.

If you don't think a few hundred hours of community service isn't a deterrent you're crazy. Maybe they should add a fine of like, 500-1000 dollars, but it's much more preferable than jail time. Jails are already overcrowded and cost a lot of money, let's at least get some free work out of these liars.

A crime should be punished in accordance to the harm it causes the individual and society. I don't think you and I have similar thoughts on criminal punishment. Being incarcerated is very different from serving your time in the community or being under house arrest. Three months in prison can be worse than three years of community service, and I would take the later without question, if given the option. I think anyone would. It is a slap on the wrist to spare her jail time, and I'm not basing that on my feelings—that's what I think.

It's not seen only as bad as graffiti. It's not seen as a crime AT ALL. She was punished for wasting police time. NOT for her malicious attack on her victim.

Probably not. As far as I'm aware scotland doesn't have anyone in long term solitary (england has one person Charles Bronson). First time non violent offence would be unlikely to result in a prison term.

Fair penalty for wasting police time which was all she was charged with because falsely accusing someone of rape is NOT A CRIME

Farmer pleaded guilty to falsely claiming she was raped and causing police to devote their time and services in an investigation she knew was false

Victimless crime. She just cost the police money. Comparable with graffiti or using too much toilet paper or something. She is treated exactly the same as if she had just pretended to be raped without maliciously identifying a victim of her lies.

She wasn't being punished for falsely accusing the man because that's NOT A CRIME
