For starters, I don't need to be told to get a lawyer. I'm not going to substitute any of the opinions in this thread for qualified legal advice.

Once again: I know that I will eventually need to speak to a lawyer.

Wife of 9 years has outstanding debt from a legal settlement against her to the tune of $40k. She also has a history of questionable decision making regarding money and everything else in her life. I've told her that while I care for her, I frankly don't trust her when it comes to finances and that I will never, under any circumstances, enter into a mortgage with her as long as we are married. I'd rather piss my money away on rent and bullshit than see half of my hard work be ripped from me one day or have her jeopardize it with her shitty life choices. However, we have two girls and I don't really want to upset their lives. I make more than her by about 20k. I also pay all the bills and the vast majority of groceries.

A while after telling her this, she approaches me and says she'd be open to getting an amicable divorce if it means that I'd buy a house.

This is kind of the scenario that we all naively hope for... some sort of amicable separation that doesn't involve lawyers. She and I would continue to live together, raise the kids, and she could count on me for security... but she's not entitled to take half of what I build in equity.

Of course - I'm sure there's all kinds of ways this can backfire on me. I would assume that if she changes her mind that she can move out, demand child support, etc... but would that really put me in a worse position? I have looked into what constitutes a common law marriage, and as long as I don't hold her out as my wife, and I don't allow her to portray us as still married, which we really haven't been doing, then can she claim that our divorce wasn't "real"?

I suppose what I'm asking is, in your opinion, is there any reason to go along with this in the hopes that we avoid a costly and litigious divorce, and that maybe I gain a measure of economic freedom from her shitty decisions and she continues to benefit from the stability and comfort I provide?
