If you are certain that divorce is inevitable then close the joint accounts and open up separate accounts. Don’t even give them the chance to hang a large debt around your neck. And if your divorce is assured, there is no reason not to file immediately. Get the case started and any debts incurred by her will be hers to handle.

In my state, an automatic financial restraining order is activated as soon as you file, and it takes effect for the other spouse once they are served.

As others suggested, talk to an atty.

In the meantime, tread carefully.

I am not a lawyer and suggest you book a consultation with one. I'd assume, essentially the sooner you file, the sooner you won't have to worry about it. In my jurisdiction, the date you are generally free from financial abuses of your stbx is at the ICMC or initial case management meeting.

What is your credit limit on the cards? Would you be able to comfortably pay that? She can't go above that.

Hire an attorney and file immediately. My ex had a couple of cards in her name(she used my income to get them without my knowledge.. WTF is this not a crime?) and she basically maxed them out before the divorce was filed. I got stuck with $30k of that debt.
