I would say file jointly and claim 0 marital property. IF she has a job, its a waste of time trying to figure out 401k appreciation in 2 years and then deducting for taxes, lawyer fees, discovery etc. The amount will be too small

With only you moving, I’m pretty sure you’re stuck with Texas. But, that’s not so bad.

Since the marriage was only 2 years. Find the statement for your 401k right before the wedding. That’s what you brought into the marriage. You’ll only split the difference between the current balance and that statement balance.

Believe me, you’ve got it easy compared to most guys on here. After 20 years, that math gets a whole lot different.

Texas is a community property state. So if you cannot agree on a split of assets, all community property is split 50-50. In Texas alimony is usually not granted. So since you are in Texas which grants no fault divorces I don’t see the need to move to another state and the wait to establish residency.

For this duration with no kids, you’re not looking at much difference between states.

Just finalized my Divorce a few days ago. I'm from Illinois.

Pretty simple here, we were able to work everything out ourselves and when we went to Court the Judge was fine with it and just asked us to confirm.

We had no Lawyers, No Kids, Never combined Bank Accounts or Credit Cards. So we each just kept our own Bank accounts, 401ks, and Debts...In order to play it safe I had us both sign a Agreement and then got it Notarized and the Judge went straight off that.

So I would get an Agreement saying that you worked out everything and will each keep your own Debts, Assets and Retirement accounts. So in other Words.

Illinois is pretty easy.
