Because society (and feminism) sees women as objects that are acted upon, and women's sexuality as something sacred, while they see men as agents who act upon others and who are always up for getting laid.

Also, society (and feminism) prioritizes the protection of women, therefore when women are harmed (even by their own idiot decisions), it is obvious that they were not protected properly by the man.

Also, women are more likely to seriously regret sex, simply because in strict biological terms (the basis of our instincts is biological, and doesn't consider the much more substantial risks men face relative to women these days, since the morning after pill, legalized abortion and draconian child support laws) a woman who made a shitty decision in that regard was stuck with the potential biological risk and investment of pregnancy only to have a sub-par kid and an up to 4 year hiatus (decreased fertility due to lactation) before she could try for a better one, while a man could walk away without investing anything in the child and try again with a better woman as soon as he could spring another boner.

Because feminism is by and large a female supremacist movement. They will happily use any tool in their power to gain privileges for women, and if it negatively affects men, they're cool with that.

And yes i know not all feminists are like that.

The laws on this situation vary from state to state. In some places, simply being intoxicated is not enough for it to legally be considered rape...but in other places, like Kansas, you'll see laws like this:

21-3502: Rape. (a) Rape is: (1) Sexual intercourse with a person who does not consent to the sexual intercourse, under any of the following circumstances:

[...]

(C) [...] when the victim is incapable of giving consent because of the effect of any alcoholic liquor, narcotic, drug or other substance, which condition was known by the offender or was reasonably apparent to the offender;

It's that "which condition was known by the offender or was reasonably apparent to the offender" bit which allows for some consensual situations being prosecutable as "rape" (i.e. two drunk people who know they're both drunk and fuck enthusiastically). Couple that with an antiquated view of men as moral agents and women as moral patients, and you have a recipe for consensual drunken hookups resulting in a man being labeled "rapist" and a woman being labeled "victim" (which causes more problems).

TL;DR:: it happens because of sexism and short-sighted laws.

To my surprise, I recently found that this sort of principle goes a long way back. Ernest Belfort Bax in the Fraud of Feminism, published in 1910, points out a number of laws that, even though passed and administered exclusively by men privileged only the other sex.

As one example among many, he cites Britain's prostitution laws which allow women to work as prostitutes, but prosecute any men who receive a part of the money so gained. He cited a real case of a man living with an older woman who did not know she was on the game. Despite his having supported her, the fact that she gave him some money was enough to have him sentenced to one month's hard laobur. The judge commented that he was "more sinned against than sinning" even while announcing the sentence.

Here's a question I use as a reality check on the issue of "drunk sex = women is victim"

The choice to have sex is a decision made by an adult. The choice to drive a car is another decision made by an adult. When you add alcohol to one of these - the person deciding to do it is guilty of an offence if it's driving. But if its having sex - guilt is allocated by sex. Taken to a logical conclusion, women must also be exempt from responsibility when driving drunk. Or, if there's still an illegal act going on when a woman drives drunk, its the car, raping her.

Why is it that in a situation where two drunk people sex, the man is always the aggressor?

Men need to start assuming the role of a victim, rather than assuming the role of the falsely accused. There is no reason that men can't do this, but the fact is that they don't. It is because they don't accuse women of date rape via alcohol that no prosecutor will go forward. Shaming language is still very effective on some men, and they don't want to be called whiners. They shouldn't act indifferent to their own grievances, they should be indifferent to the shaming language!

Women don't want to be held accountable for their bad decision making. Women want have the privilege of being a total fuck-nut while under the influence of alcohol and then be able to say "Oops, sorry I was drunk, not my fault, tee-hee!". In some cases you'd be considered lucky if you even get an "I'm sorry".

Doesn't it simply come down to the biological fact that women can have sex whether they want to or not (hole, no boner) whereas men can only have sex if they have a boner, so it is hard to argue that a man didn't want it if he had a boner?
