He is seriously claiming a six year old should be familiar with sexual assault and age of consent laws?

I can't conceive of even the most mature six year old appreciating those concepts.

If the boy has a learning-disability, couldn't this also be viewed from the opposite perspective: that the little girl was "taking advantage" of him? One would assume this would make her the one who should "know better."

While this boy was likely engaged in deviant behavior (and perhaps even a pattern of deviant behavior, based on the previous events involving babysitters), it seems likely that his behavior stems from his recognized developmental disorder (for which he is already receiving treatment) and medical procedures performed on him (the article mentioned him having received a number of enemas in the past. I could see this influencing his behavior much in the same way that child victims of sexual abuse often engage in hyper-sexualized behavior while still prepubescent). That he is being treated according to doctors' recommendations should be enough here.

What's killing me, though, is that the premise of the charge is that the girl did not give consent, and she couldn't give that consent because of her age, whether she voluntarily engaged in the activity or not. In the same vein, how can the boy be charged, no matter the voluntary nature of his actions, with an action that he, due to the same limitation of age, could not legally consent to? The same argument is often brought up in child support cases where the father was under the age of consent, but it seems especially applicable here.

One other thing that got to me was that the article didn't really clarify the end result of this process. If I read it properly, it doesn't seem like he's being charged criminally, but I didn't really get a feel for how the case was supposed to turn out.

This shit happens when a lawyer is looking to make an extra buck by opening these chickenshit cases. A lawyer tells a parent they can make a lot of money by suing someone for anything and the lawyer ends up making the dollar.

Riniker said she made that determination using her discretion as a prosecutor. She also said she has more information about the boy’s actions than she included in the complaint.

What is even perverted and criminal about this and why would the boy be the only one at fault?!?

Also, I was expecting a while Knight to be pushing the case... it some sick woman trying to see a boy as a rapist. No words.

This is just absurd.

Everyone's all "ZOMG don't tell the kids about sex or ruin their innocence" so they don't get told anything. Even IF that little boy DID touch the little girl somewhere he shouldn't have, does he really know the difference? If no one explains what body parts really are to children and the meaning of touching them, is it really some sort of assault?

It's just stupid that a 6 year old boy is being accused of something like that, especially when it's against the word of a 5 year old girl? Come on.

The parents should be charged with poor parenting.
