Though she filed the rape claim against Doe with Lynn’s Campus Security office the day after their liaison, in a video-recorded interview with female detectives at the police station, the accuser never claimed he had raped her, according to Doe. The police report says she told them her friends and parents wanted her to accuse Doe.

The university didn’t bother calling the detectives who investigated the claims, and their report was not given “any consideration” in the campus hearing, the suit says.

Part of the police investigation involved reviewing security camera footage to gauge the accuser’s level of intoxication and her ability to consent.

It showed her walking, acting normally and “smiling” before and after her encounter with Doe; at one point, she’s seen standing on one foot while kicking the elevator door button with the other foot, the suit says. She was also seen dancing on the soccer field with one of her friends.

Due process by the University.

It is still good to know that members of the protected group are protected.

Universities should be more honest with young men from the start. Instead of telling them that women are their peers and equals they should inform these young men that their relationship with female students is more like a babysitter/child relationship when alcohol is involved. Men will be responsible for the actions of the women as well as their own, much like it is when looking after a child who can't make decisions on their own. This might help clear up the confusion.

I wonder, an experienced lawyer would recognize they're participating in a kangaroo court, wouldn't they? Couldn't that constitute misconduct? Believe it or not, Lawyers are held to a legal standard of ethics, and this is anything but ethical.

The Fix is not identifying the accuser in this story, in keeping with mainstream journalistic practice on alleged victims of sexual assault.

The suit says that Boca Raton Police found that Doe and his accuser had consensual sex at a dorm party with alcohol last fall, and called her belated rape claim “unfounded.”

It looks like, "The Fix" is certainly in.

Here is what needs to happen in cases like this.

File a motion to disbarr the representing attourney if they have been informed of the fact the defendant is not granted representation. Makes a lot of fus and leaves staines on that attourneys jacket. Makes it also fun if the representing attourney has to explain why he or she participated in something knowing the defendant was not even granted adequate protection. Anyways, gives your lawyer the right to be there. After all, your lawyer is only serving her lawyer the papers, not participating meaningfully in a case. And to act as a whitness just in case her lawyer decides to open the mouth, because you know, disbarrment procedures usually require lots of testimony and eyewitnesses and such. After all, if this is nort a legal case, would those University people please explain to a lawyer present why they decide to interfere with the proceedings of what does not concern them?
File a title IV faster then they can say "Hopscotch". Claim in it that the people who signed any peace of paper, or uttered any declaration of "why a lawyer can't be present for the defense, but for the offense...", are in fact discriminating against the accused on the basis of his sexuality, sexual identity, AND his religious worldview that forbids him from entering a legal situation without legal representation.

If she retracts her claims right now and publishes the retraction in the schools paper, including a handwritten letter of apology to your mother for scaring her like this, you are willing to cut down heavily on punitive damages. Offer persists till the accusations get picked up by media big enough to make it impossible to remove this, then punitive damages will include lost lifetime earnings.
