I would quibble with the suggestion that women are always seen as the victim and men as the aggressors. In cultures where people drink a lot, it is accepted that both parties can consent when drunk. The issue arises, rightly, when one of the parties is so drunk they cannot consent (basically unconscious). Drunk sex, in itself, is totally legal in any jurisdiction I know of. People do things they wish they hadn't when drunk sometimes (e.g. have sex with someone they regret having sex with afterwards), but we all make mistakes and have to take responsibility for them. Sober people can also have sex with drunk people. That is all perfectly legal and happens in practically every happy marriage.

It is whole different matter if, for example, a drunk man comes across a passed-out woman in a bedroom during a party and proceeds to penetrate her. That is so obviously rape. But it is also difficult to prove without third-party witnesses, as the only witness who could support the prosecution was unconscious at the time.

Cases involving consent and intoxication sometimes hit the headlines. But they are extremely rare and nothing to worry about. If two people are drunk and want to bang, let them go for it. But if one of you is just too drunk, people normally just sleep it off and carry on in the morning.

The worst situation is when someone is very drunk (but seems to just be merry) and suffers from memory loss. They are obviously going to feel very vulnerable and worried when they sober up. Some people may make up accusations to maintain their self-image, but almost invariably people just laugh off their stupidity and carry on with their lives.

There’s a difference between 2 people blacked out having sex. And someone who’s drunk and having sex with someone who is passed out.

I know women who were raped while they were passed out and the guy was super drunk. No matter how drunk you are, having sex with a person who’s not awake or able to consent IS rape.

Look at The Brock turner case. They were both drunk but the woman was literally passed out. The witnesses were so horrified by what he was doing that they stared crying.

Because the patriarchy as a system (not blaming individual men born into it) makes us perceive men as parents/fully formed adults and women as children/lesser than.

Almost every single gender based issue boils down to this. Men got the better end of the stick despite some drawbacks (like the subject of this post) so it is often ignored on this sub and across the manosphere, despite being very obviously the core of the problem.

Interesting question indeed. If a drunk friend tells you to ride back home, on your onw bike, alongside with him, and you end up having an accident, they won't prosecute him ; it's your responsability.

We often hear "B-but you proposed a drink !" as if someone else was responsible fro handling the alcohol consumption of someone else he doesn't even know.

Whist the women being the victim and the man being the predator is usually the case it’s not always 100% However, a blacked out man drunk (where you can’t remember the next day) or passed out is rarely able to maintain or even get an erection so a women trying to rape him the old fashioned way is going to be difficult to say the least.

It's rape if she's unconscious or passed out, however, if she's merely just drunk and agrees to sex, then i think she shouldn't drink if she's going to regret even that.

Because in the West we have a guy ice truck society. This is one T the case in the East. IMO, if both people get wasted and want to have there is no victim. To say women are victims, and men aren't, is blatant misogyny and misandry.

I can't tell you how much drunken sex I had when I was younger. Those were to good old days.

If you have sex with someone who is unconscious, that is bad. But other than that, being drunk shouldn't mean you didn't consent. Neither should not remembering mean you didn't consent.

The sad truth of all this is that the reason there is so much sexual assault is that getting proof is very difficult. But you cannot sacrifice the presumption of innocence and burden of proof, no matter how well intentioned. That is deadly to society. We will have to reduce SA some other way.

If a man gets extremely drunk, he has the risk of getting ED to some extent. Anything from quick losses of erections to total prevention, and this has been documented in various studies. However, barring a woman passing out, there’s no change in a sober and drunk woman from that perspective. So, if there’s evidence she was drunk (usually a friend’s confirmation), there’s evidence that a rape occurred as if the man was drunk sex would’ve been extremely unlikely. Unfortunately this is not a perfect mindset as not all men get alcohol induced ED, many men can still manage sex with partial ED, and it’s difficult to prove the level of drunkenness the woman has at the time of sex unless she’s investigated immediately after which is extremely unlikely
