Head to thefire.org, and go to the section where it says request help and explain your situation. They're a nonprofit organization dedicated to preserving civil liberties for students on campus, and that includes your right to due process. I've seen some videos that they've posted on youtube about those they've helped through false accusations, and they are definitely the type of people that you want in your corner for what you're about to go through.

Second, do not say anything about the experience to anyone, including her in case she has a recorder on her. Most of all, do not say ANYTHING to the police. If they come and ask you questions, repeat that you do not feel comfortable answering their questions without a lawyer, and ask if you are free to go. Keep doing this until they let you go. Remember, the police are not your friend, as they only want to incriminate you. Needless to say, if you are at this point, you will need to get a lawyer. Some non-profits sympathetic to your situation may be able to help you out, or maybe not. I listed one above.

Third, do as some other posters have said and get a record of any messages exchanged with her from the phone company. Also, if there is any potential video footage showing her reciprocating interest, maybe dorm security or a convenience store, obtain that as well.

Fourth, you need to understand that the modern rape accusation on campus has two parts; the criminal trial and the campus trial. Follow the police advice above, and you will eventually get a fair criminal trial for that. The campus trial, however, will probably be a run through the mud for you. Imagine if you were on trial for being a witch at the Salem witch trials, and that should give you an idea about what to expect. The campus trial aspect is why I recommended contacting FIRE above. Fully expect to encounter hostility at every step, as the motivation for schools to completely discount the possibility of your innocence is closely tied to things like federal funding that are a lot bigger than you

Fifth, you will need to delete or edit out the details in this post at some point. It is very specific and can possibly be used to identify you, and anything you say can and will be used against you.

normally i would be terribly concerned, but i think you'll be fine as long as you do the necessary legwork:

first, write down what happened in as much detail and as eloquently and clearly as possible. do this immediately. your story needs to not change. have your friend do it as well. this should include any communication with her the day before as well as up to when you deleted your texts. if you can remember any or all texts as close to verbatim as possible, write them down. note that you are reconstructing them from memory.

she's insane and attacked someone with a bat, so you're in good shape in that regard. she's on probation, she has problems. the main thing you have to do is not display any anger.

i would assemble a file of false rape claims, including the duke lacrosse thing, the black girl who was fucking her father, etc. this is for when they say women don't falsely accuse anyone of rape.

take the position that you are concerned for her. say "well this came as a shock to me, i'm very concerned for her. i don't know what could be motivating her to make this claim."

ask that they look at her text messages to you and the involved friend starting the day before the incident. you might be able to recover your deleted texts from your phone company. never delete texts, bro.

If you have an iPhone, look into getting the texts back. I know that sometimes when you use the [spotlight] search, content from deleted texts shows up, meaning they're still stored somewhere. Google hw. Maybe make a post if you figure it out for the rest.

Barring that, if you regularly plug your phone into iTunes, there's automatic backups that may be enabled. See if you can back up your iPhone from a week ago or something. [make sure to backup your current state first jic - it doesn't overwrite the others]. Good luck

I don't get how she is 'off them' for probation though, you don't get forced to stop taking meds for a disorder like that because of probation. Do a Google search and you will find out numerous young men are filing lawsuits against universities for being kicked out on questionable evidence as it relates to the question of consent. Things aren't like in years past when people did what they did and admitted their mistakes. Today people will try to justify their actions, especially for some women when it comes to their image.

One thing that needs to be made clear is that you need a criminal attorney, one who specializes in trial work. You don't want a criminal lawyer who can only get great deals but isn't great at arguing a case in front of a jury. I have a list of various criminal trial attorneys in my phone. I got their names from various sources. The last thing someone should do is hire someone whose practice is less than say 85% criminal work.

Most lawyers offer a free 1 hour consultation. You can go see 3 or 4 of them to get all the information you need.

Write a statement detailing everything that happened, print it out, bring it to your consultation, give it to the lawyer to read, and ask him what your next steps are, if any. Then do those steps and see another lawyer for another free consultation to get your next steps.

Or find a lawyer who's also a mens' rights advocate.

This might also be a lack of after-care. Even though you didn't fuck her, you made her feel like a slut, which she hamstered into rape.
