Technically it's community property, like a home or a car would be. You can ask for it as part of your half of the property, but you might have to trade something for it. In my divorce the lawyers made no effort to equalize anything other than cash/retirement and the proceeds from the home sale, so we had to sort it out ourselves and it came out very un-even (she took everything of value). That said, the difference was less than what I pay her every 3 months in support.

Used jewlery, especially wedding/engagement rings, has no resale value anyway. You're just going to sell it for the material value of the metals/gems.

An engagement ring is a gift given before you are married and therefore not marital property. As for a wedding ring? Again....technically given before you are married since the marriage isn't legal until the license is recorded. Splitting hairs, but that what divorce is all about....lol.

Nah it’s a gift in the eyes of the law. She can keep it if she wants to. You gotta love the mindset of some women lol. At this point just move on. I lost mine too. I looked at it as one of the reasons I was given a favor by her divorcing me. She was petty lol. Just say f it and go on

Gifts are gifts and not part of the negotiations or split. Never give expensive gifts like a car.

Separated on October 25th. I first noticed her not wearing it October 31st, she gave it to me willingly less than a week later... I stopped wearing mine after Christmas and both rings have bee buried in my safe ever since. I still get that panicked feeling very so often when I don't feel it, thinking I lost it. Then I remember and it stings all over again.
